Prosecutor's son charged with rape

The 22-year-old son of the Cortland County District Attorney has been charged with statutory rape in the town of Skaneateles.
State police said Robert Suben, of 90 Tompkins St., Cortland, is charged with third-degree rape for allegedly having consensual sex with a 16-year-old girl in a Skaneateles home on May 23. Suben is charged with statutory rape because the age of consent in New York state is 17.

Suben is the son of Cortland Count District Attorney Mark Suben.

Onondaga County District Attorney William Fitzpatrick said Tuesday his office is treating the case like any other rape investigation.

Suben was arraigned in the Town of Marcellus Court and released on his own recognizance to reappear in the Town of Skaneateles Court at a later date.

The Oneida County Child Advocacy Center assisted in the investigation, troopers said.

A 22 year old having sex with a willing 17 year old is not violence or assault. " This is a joke - it's a technicality but a pretty darn good one if someone is trying to target somebody - it was consensual - she was 16 probably looked 21 like every 16 year old does. My definition of rape is when you have sex with somebody without their consent regardless of their age. When I see these kinds of arrests it's almost an abuse of the system. Scan through the sex offender site and see how many of them are young boys who had sex with a girl slightly younger than them. That isn't a real sex offender - those aren't the predators I'm afraid of on the street / fear for my daughter over - this prosecutor's son is NOT a rapist... "
