The 22-year-old son of the Cortland County District Attorney has been charged with statutory rape in the town of Skaneateles.
State police said Robert Suben, of 90 Tompkins St., Cortland, is charged with third-degree rape for allegedly having consensual sex with a 16-year-old girl in a Skaneateles home on May 23. Suben is charged with statutory rape because the age of consent in New York state is 17.
Suben is the son of Cortland Count District Attorney Mark Suben.
Onondaga County District Attorney William Fitzpatrick said Tuesday his office is treating the case like any other rape investigation.
Suben was arraigned in the Town of Marcellus Court and released on his own recognizance to reappear in the Town of Skaneateles Court at a later date.
The Oneida County Child Advocacy Center assisted in the investigation, troopers said.
