SYRACUSE -- Prosecutors say they will not pursue a third assault trial against a Syracuse woman who says her infant daughter's lung injuries nine years ago were caused by exposure to toxic mold, not child abuse.
Instead, 25-year-old Brandi Gallishaw was sentenced Monday to time served for a misdemeanor child endangerment conviction in March. A jury had deadlocked on the more serious count of first degree assault, leaving prosecutors with the option of trying Gallishaw again on the felony charge.
Gallishaw was originally convicted in 2001.
That conviction was overturned last year after defense lawyers produced photographs apparently supporting their claim that the baby's pulmonary hemorrhaging resulted from mold exposure and not attempts by Gallishaw to suffocate her.
