The Cayuga Nation of New York has stopped selling cigarettes from its Lakeside Trading stores the day after a Supreme Court Judge ruled against the tribe in the most recent round of litigation.
On Wednesday, Judge Kenneth Fisher said the Cayugas must abide by his Dec. 9 decision when he ruled that the district attorneys in Cayuga and Seneca counties can charge the nation with tax evasion for selling untaxed cigarettes to non-Indians.
The nation has appealed Fisher's Dec. 9 decision to the state Appellate Division, and a decision is not expected on that issue until May.
Lee Alcott, an attorney for the nation, said that the nation will also appeal Fisher's most recent ruling.
The appeals stem from the Nov. 25 raids of the Lakeside Trading stores in Seneca Falls and Union Springs, when sheriff's deputies seized nearly 3.5 million untaxed cigarettes.
The Cayuga Nation has maintained that its status as a sovereign nation exempts it from collecting sales and excise taxes.
