The judge reviewing motions in the Cayuga Indian Nation of New York cigarette tax case will not be making any decisions today, he said this morning in a hearing in Cayuga County.
Judge Kenneth Fisher said he'll issue a written decision early next week on the matters now before him.
Attorneys for the tribe and Cayuga and Seneca counties, whose district attorney's offices are investigating tax evasion allegations, argued their points this morning regarding the Cayugas' motion to get back the 3.5 million cigarettes seized from their convenience stores in November as part of the investigation.
Further proceedings, including a motion by the counties to force the stores to remain closed pending an appeal decision, are scheduled to begin at 11:30 this morning in Seneca County.

The county DAs contend the tribe has been violating the law by possessing and selling untaxed cigarettes. The tribe claims it is exempt from taxation laws because it is a sovereign nation.
The investigation has been put on hold by an appeals court until it makes a final decision on the legality of the counties' actions.

You pay the tax based on where you do the business (in this case it's New York State) not on where you are from. "
