Parents of murdered Palermo girl reject plea deal

PALERMO, N.Y. - The parents of an 11-year-old central New York girl who authorities say was murdered by her 27-year-old stepbrother will go to trial on child endangerment charges.
Lindsey and Lynn Maxwell rejected a plea deal Monday night in Palermo Town Court and said they wanted their day in court.

Lindsey, 35, the girl's father, and Lynn, 53, her stepmother, were each charged with six counts of endangering the welfare of a child and could face up to a year in jail if convicted.

Sal Lanza, the lawyer who represents the couple, said the deal would have had the couple plead guilty to one count each and face prison time.

Oswego County authorities said Erin Maxwell was living in deplorable conditions in a house filled with garbage and more than 100 cats. Authorities said Erin went to school wearing clothes reeking of cat urine, was locked in her bedroom every night and was often desperate for food.

Maxwell, who weighed only 65 pounds, died at a Syracuse hospital Aug. 30. An autopsy listed the cause of death as asphyxia.

The couple has suggested Erin accidentally hanged herself while acting out a scene from her favorite movie, "Pirates of the Caribbean: At World's End."

However, authorities have charged Alan Jones, her stepbrother, with second-degree murder. He remains in the Oswego County jail on $500,000 bail and is due back in court Jan. 6.

Lanza also filed a motion to have the charges dropped against the Maxwells. The couple is due back in court Feb. 16, when the district attorney is expected to respond to the dismissal motion.
