State to pay Roy Brown $2.6 million

The state of New York will pay Roy Brown $2.6 million for his wrongful imprisonment.
The two sides arrived at that settlement amount Tuesday morning prior the start of a damages trial that had been scheduled in the state Court of Claims in Syracuse.

Brown was released from prison last year after having served 15 years for the murder of a Cayuga County social worker. New DNA evidence exonerated Brown and pointed a different prime suspect, Barry Bench, who had committed suicide.

A court of claims judge earlier this fall had ruled that Brown had proven he deserved to be compensated by the state. Brown's original claim had sought $5 million.

The trial was supposed to have started Monday, but both sides said a "wrinkle" had come up in settlement negotiations, so the judge gave them another day. Neither side today was saying what the wrinkle was.

" No, he wasn't necesarily an upstanding citizen before his incarceration. But let Mr. Brown have his million bucks. He will more than likely be broke with in five years, and back on public assistance. Anybody wanna wager? "

" I believe that it is possible for a person to change, for better or for worse.
If Mr. brown's comments about helping others that he knows, who could really use some help are sincere, then he is someone to be admired for his attitude and future. "

" OMG your worried about him getting paid for his suffering,,,,,,,wait til the start of the asbestos lawsuit this year 2.6 mill is nothing compared to 30 lawsuits each looking for 10+ million from the county where all those people where exposed to a substance that will give em lung cancer "

" I think its a fair settlement. Out of that cash he has to pay back a large kidney transplant bill that the state picked up for him as he was on deaths door upon release. He will bag about 1.8 million but I wonder out of that how much does that lawyer of his get? I hope not much because it was pretty much in the bag that he was gonna be reimbursed. "

" wasn't a new liver or kidney or whatever it is that he got, almost immediately after getting out of prison, enough compensation? let us not forget he was not the most upstanding citizen to begin with. please do not put this man on a pedestal! "

" Don't expect the taxpayers to foot that bill!!!! Make him reimburse the state for housing, food and clothing for the 15 years he served and welfare payments he received prior to his incarceration, out of that money. "

" OMG half you people are very, very ignorant!!!

Oliver, you are exactly right, placing someone in prison for 15 years out of their life, for a crime they didn't commit, somebody needs to pay for it. I will WORK EVERYDAY and PAY TAXES to see stories like this!!!

I know I would be devastated if he was one of my family members, or God forbid, even myself. That money isn't going to bring back the 15 years he had to endure behind bars, but it sure will help him sleep a bit easier at night from now on.

Shame on you people for being so greedy and ignorant that you can't even celebrate with this man on this day! You should be ashamed of yourselves!!!

Congrats to you Roy Brown and your family. Justice may have not completely been served, but you all stuck through it and there ARE people on your side!! "

" Fifteen years of imprisoment for a crime he did not commit.. I say he deserves the money. Maybe now he can go on with the rest of his life! "

all the years he lived on welfare. I say pay him $1!!!!! "

" It is a very difficult decision to determine a value of 15 years taken from a mans life for a crime he did not commit.

Maybe the incompetent Judge and District Attorney that wrongfully prosecuted this innocent man should cough up the money from their nice State retirement accounts. "
