DA: Inmate’s 1989 murder conviction to be vacated

UTICA — A man who has spent 20 years in prison for a teenager’s 1985 rape and murder will be in court Tuesday to have his conviction vacated based on new DNA tests.
Oneida County District Attorney Scott McNamara says his office anticipates Steven Barnes will be released from custody after a 9:30 a.m. hearing before Judge Michael Dwyer.

Barnes, of Marcy, has maintained he didn’t kill 16-year-old Kimberly Simon, who was a Whitesboro High School classmate. He was convicted in 1989.

The Innocence Project took up Barnes’ case 12 years ago and has been working with McNamara’s office.

Although Barnes is being released, McNamara says the indictment against him will not be dismissed pending additional investigation.
