A New York State Court of Claims judge has ruled that Roy Brown is entitled to monetary damages as a result of his wrongful incarceration in the murder of Sabina Kulakowski.
The amount of those damages will be determined through a proceeding that is scheduled to begin Dec. 8.
Judge Nicholas V. Midey Jr. wrote in a decision last month that Brown did nothing to bring about his conviction, and that he has demonstrated clearly that he was not guilty of any of the crimes for which he was indicted.
Brown's murder conviction was overturned and his case dismissed in March 2007 after he spent 15 years in prison for a second-degree murder conviction in the Kulakowski case. New DNA testing had made another person, Barry Bench, the prime suspect in the case.
After being released from prison, Brown filed a $5 million claim against the state. The state Court of Claims handles such cases.
