Start collecting taxes from the Cayuga Nation

On Nov. 18, will we finally bring resolution to the Indian tax issue?
It is no secret the chess game continues regarding the collection of taxes from non-Indians. The Cayuga Nation has dug in their heels, and will not change its position. Even though the opposition is strong. Unfair to convenience stores, a landslide negative opinion both vocal and print, a 2006 court ruling with a strong opinion that the state can collect these taxes! But here we sit two years later with no action. Having worked at Lakeside Trading for nearly a year, and now at another store, it is a matter of time that others will close. It is so unfair to hard-working people in Cayuga and Seneca counties that operate convenience stores.

It may take our financial “crisis” for this state to act on the collection of these taxes. Gov. Paterson is calling back the Assembly and Senate to deal with a multi-billion dollar deficit. As they meet on Nov. 18, I am sure they will slash many worthy programs, which is sad. In addition, they will be challenged to find “other” revenue streams.

The Cayuga Nation will be under an intense spotlight as legislators across this state know full well a move to mandating this collection will represent close to a billion dollars, revenue that we need for our coffers. (Year 2007 data.)

Legislators from across the state have expressed shock that this tax has not been collected to date. Citizens are calling for action, and I just can't fathom that this hot issue can be swept under a rug like many times before.

Folks, this is not “chump” change. We are talking close to a billion dollars!

Let's hope that Tuesday, Nov. 18, will not only be known for being Mickey Mouse's 80th birthday, but a date that finally resolves this tax issue. We as citizens have waited long enough. It is time for action!

" In northern Massachusetts we deal with this every day. Six miles from my house is the state of New Hampshire which has no sales tax. The cigarette retailers survive on both sides of the border. The Mass stores usually sell only single packs of cigs which are more profitable than cartons but residents will purchase packs rather than make the short ride to NH. When they get their paycheck they will go to NH to get a carton but the retailer there makes less profit on a carton. Each state has their niche sale and deals with it. When a Mass resident files his state tax he is SUPPOSED to report the sales tax he did not pay. Like that ever happens. If a retail store tries to sell cigs they purchased from NH their inventory is confiscated and they are fined $100 per carton in their inventory. NYS residents should be limited to possesion of no more than 1 or 2 cartons of cigs without a tax stamp or face a fine and collection of taxes due. This should slow down the Indian cig sales. The Indians are doing what is their right but the avoidance of paying taxes is the fault of the NYS residents. Also a factor is if the selling place is tribal land. If not they should collect sales tax. If it is tribal land they should not be liable for being tax collectors for NYS. "
