DA ignoring double

jeopardy law in Davis case
I am writing in response to the “Our View” article written back in October regarding Michelle Davis. I could not agree with your view more! I think this is a futile attempt by the DA to underplay the courts error by diverting everyone's attention back to Michelle.

Michelle had already been tried, convicted and served her sentence mandated by the courts. Doesn't this sound a little bit like double jeopardy to you? Isn't the DA basically asking for the new judge to charge her with the same crime twice?

You mentioned that they had the option to try and convict Michelle on more serious charges and they did not. So, now that their predecessors are no longer in office, it is OK for them to defame and disregard their original decision. And why is it that Michelle Davis' case seems to be a greater topic around election times? First the death penalty and now this? Are we expecting to see this happen to others that have been affected by the court's oversight? According to the news report, Michelle is not the only one that this happened to.

And as far as feeling she should have served more time, she will be serving time forever as she has to live with the pain and the guilt of this for the rest of her life. Michelle paid for her actions, let the court pay for their own!

And there was indeed plenty of evidence to show to violence that Michelle endured so what makes you so sure she it lying?

Regardless of the crime - the court messsed up. There were several other people that had the same error with the courts- what do you hear about them? Whether you like it or not - the DA had the opportunity to go for more serious charges. Obviously they didn't so it was not as "obvious" as you may think. "
