Brutus unanimously OKs 2009 town budget

WEEDSPORT - The Town of Brutus' 2009 budget passed unanimously Monday night.
The $338,280 budget with a tax rate of 1.99 percent showed a minimal increase of .1 percent over the 2008 budget of $322,523, with a tax rate of 1.89 percent.

“We want to be cautious in spending and see what revenues are coming in from sales tax,” Town Supervisor James Hotaling said of planned projects for 2009.

The fire district budget was also passed.

The town board discussed a number of requests from town residents. Floodway problems with the Pacholyk property on Oakland Road were discussed with town engineer Tom Piascik.

He said new mapping shows that half the Pacholyk property is in a floodway. A culvert near the railroad track builds a dam and the water backs up.

In order to get the floodway changed, FEMA would have to be contacted.

“You could put a house up on piers,” Piascik said, “but that doesn't make much sense.”

The board also looked into a petition from residents on Ball, Hamilton and Centerport roads as well as Route 34, requesting the establishment of a water district.

Board members discussed a number of ways a water line could be routed in order to provide services to residents who requested them.

“People have talked about this for 20 years,” councilman Dave Miller said.

“It's too sparse to afford a water line,” Jeff Hinman, councilman, said.

The board will have the town engineer prepare a preliminary cost analysis, as all members of a new district have to share costs of establishing that district built into their bills.

The board will acknowledge the receipt of the petition and meet with the residents once the figures are available.

The board also considered a request from Case and James Marshall to establish a water and sewer district for their properties on East Rude Street, using the village's services.

The board will send a letter to the village to find out whether it is willing to provide these services.

Hotaling said he believed that U.S. Sen. Charles Schumer would support pumping federal money into infrastructure to get the economy moving next year.

He said the town was ahead of the curve in that it already has projects in the works.

“There's a good chance to be in a position for funding,” he said.

In other news:

** The board considered a complaint of dumping soil and gravel on Becker Road. Trucks filled in a drainage ditch in the town's right-of-way.

The DEC did not require a permit because the property was not a wetland. The town engineer said he was surprised no permit was required because it is an area of concern, adjacent to wetlands.

The town will contact the Army Corps of Engineers to inform them they need a permit to work in the right-of-way and a drawing to know what is going on and how they will clean it up.

** The board resolved that an e-mail and letter will be sent to Cricket Wireless noting that their tower permit will expire on Nov. 8 and that they will have to renew their it if they fail to comply with the terms of their permit.

** Dunn Road, which lies immediately south of the Thruway exit, has been a problem for trucks turning around and damaging private property there.

The state is putting a larger stop sign at the Thruway exit and a dual warning sign in the northbound direction. They suggested putting a No Outlet sign at the southernmost driveway of the park-and-ride lot.
