Woman not at fault for buying tax-free cigarettes

Friday, October 24, 2008 12:13 AM EDT

This letter is from a person who doesn't smoke, but my family members and my significant other of 25 years does.
So what I'm about to say will probably make some people mad, but it's called freedom of speech and peoples' rights that are being infringed upon.

The woman that's being accused of tax evasion because she bought five cartons of cigarettes, myself and others have talked about at great lengths. It's wrong, because if a law is passed, people should be aware of this.

Plus, when people do purchase their cigarettes, cigars, tobacco, etc., there should be signs that tell them how many they are allowed and if not, then she or others shouldn't be charged.

I'm sure you can think of other things in our country (more serious) to charge people with.

Plus, come on, you're putting people (such as growers, farmers, migrant workers, store owners, etc.) out of work, and an income, no matter what. Our country is losing too many rights, our freedom of everything we all fight for.

So stop, and begin thinking of our country and people who are fighting for all of our rights and the ability to live in the land of the free.

" She is not at fault for buying the cigs she is responsible for paying the taxes. There is no controversy, just the law. Submit the tax payment to the state and go to court with the proof of payment. Don't try to claim you are not responsible. "

" Upstate NY has to deal with some Indian tribes that are very aggressive about their rights and sovereignity. Historically they have a valid point but it is a problem with the government not the current residents. I understand the resentment when they claim rights to property you own but that is a claim that the feds must settle. They are not attacking you. There is a very racist tone in upstate NY due to this history. The nation has a responsibility and has to settle it and not try to enforce treaties and pacts that were forced on the tribes by force. The native americans need to be respected and dealt with not scorned and hated for pursuing what is theirs. "

" This tax law in new york is not right for the indins to beging with the indians were here first. You stole the land from the indians so now when you want to taxe them wake up new york. I every time I come to new york I am afraid to bring cigarettes. I as I buy them in Mo. "

" New York State either has the highest tax on cigarettes or is darn close to the highest. If a person want to smoke its their choice, and if the the cost of a pack of cigarettes is cheaper at the indians store go for it, New York State made it impossibe for the ones who want to smoke,to buy smokes at a taxable store. Iam a nonsmoker, but if a person wants to smoke, I don't blame them for buying at a cheaper place. New York put the smoker in that position. "

" If I go to New Hampshire to purchase cigarettes or any Massachusetts taxable item the state if Mass holds me responsible for paying the taxes. If I am caught not paying them I am subject to charges of tax evasion. Why is she different because she bought from Native Americans in racist upstate NY? "

" brew quit your garbage. there is a difference between income tax evasion and buying smokes from american indians. why isn't more time and money being spend on that, instead of petty little crap like this. "

" I is your responsibility to pay sales tax if the seller does not collect. Ignorance of the law is no excuse. I hope you saved a lot by avoiding paying your taxes. "
