Police say man raped woman as she slept

An Auburn man who authorities said is in the country illegally was arrested by the Auburn Police Department Sunday morning after he was accused of raping a 27-year-old woman in her sleep.
Officers accused Arturo Juan Bautista, 31, of 46 Maple St., Auburn, who they believe is a migrant worker, of raping the victim during a social gathering in her Osborne Street home.

When the victim woke up, she screamed for help and attempted to fight Juan Bautista off as he allegedly continued to attack her, police said.

Officers said Juan Bautista was found heading north on Osborne Street after he was allegedly confronted by several other residents. Officers believed Juan Bautista was a guest at the house and had been drinking alcohol during the gathering.

Cayuga County District Attorney Jon Budelmann said that while Juan Bautista could be deported instead of proceeding to court, Budelmann planned to pursue all legal options.

“If the defendant gets acquitted, he can be deported; if he is convicted, he will serve his time then be deported,” Budelmann said. “If we just deport him and he is guilty, he can just come back to the country and then we just let a rapist back out.”

Juan Bautista was arraigned in Auburn City Court, where he pleaded not guilty to first-degree felony rape, and was remanded to the Cayuga County Jail without bail.
