Without town's OK, Bonca's opens doors

Though it hasn't secured a certificate of occupancy from the town of Sennett, Bonca's is open for business.
The owners of the former Pioneer Restaurant property put an “open for ice cream” sign outside its Route 20 building Saturday afternoon to invite people in for just that. The restaurant won't be fully operational for another week or more, according to Greg Rigby, one of the partners in the business. Cooking staff needs to be hired and food product needs to be delivered.

The town code enforcement last month inspected the property, which has been extensively renovated from its condition when the Pioneer closed. Rigby said the business fixed all legitimate problems raised at the inspection.

But this week the Bonca's owners received a letter from the code enforcement officer, Paul Weiman Jr., with a long list of new problems.

At the end of the letter came a warning against opening the business without the certificate. “The Town will seek an immediate injunction along with damages for attorney's fees and will prosecute you and your partners criminally to the fullest extent of the law,” Weiman wrote.

The owners feel confident they've done everything legally they need to do to be open.

“I'm expecting that these guys will come to their senses and see that what we've done is not that terrible,” Rigby said.

Early Saturday evening, customers were starting to trickle into the building and onto the outside deck. Though meals are not being sold at this point, the restaurant's menu is written out on a large blackboard behind the counter. Several people stopped in just to see the inside of the building.

Rigby explained that the company had stocked up on a lot of ice cream and had been training employees to serve it. Saturday was their first day to serve customers.

“We had a lot of product and didn't want to have it go bad,” he said.

Five employees, all part-timers, were serving inside and outside from a menu of soft ice cream and 16 flavors of hard ice cream.

Bonca's is expected to be open every day, though specific hours are still being worked out.

On Saturday, Rigby was planning to personally be on hand until the business closed for the evening.

“Just in case the town wants to raise some objection, it will be me that deals with it rather than an employee,” Rigby said.

The business has been wrangling with the town for almost two years in a case that ended up in state Supreme Court over issues involving non-conforming use and the town's zoning laws. The Sennett Town Board essentially sued its own zoning board of appeals over a decision earlier this year that allowed the Bonca's project to progress. A judge sided with the ZBA and urged all the parties to avoid a return trip to court by working out their differences.

Rigby said the business has its permit from the Cayuga County Health Department, and he's confident there are no building code violations.

The town of Sennett can issue an appearance ticket or seek an injunction if the business has violated the zoning law and opened without a CO.

Both Weiman and town Supervisor David Sikora were unable to be reached for comment.

" Congrats on your on your opening Bonca's! It is just too bad that these small-minded members of the town board of Sennett are allowed to run their town that way. If I lived in Sennett, I would be ashamed of them! Vote their butts out of office!! "

" "He mentioned landscaping, a fence, a sign package #* including the Bonca's sign and menu sign #* and building awnings that weren't included in the original plan and constitute a change to the exterior or the building, also requiring relief from the zoning board." YOU HAVE GOT TO BE KIDDING ME!!!!! Beautiful landscaping, a fence, a sign and awnings are now an issue. I don't live in the Town of Sennett Mr. Weiman appears to be extremely power hungry. What, were one or more of the owners mean to you when you were a kid. Mr. Weiman, and this is your way of getting back at them????? We should be welcoming new businesses that hire local people not driving them away. Let Bonca's open! "

" The little towns have boards that are a bunch of dictators. The power of the office goes to their heads. At election time they will all disappear. Unless the town has a procedure to remove them sooner. The restaurant owners should sue the town for obstruction and lost business. "

" Only in our LiL community can this go on -- compared to what WAS THERE --You would have to be NUTS to say no. Did anyone ever eat and look in the Pioneer? Enough said "

" This is an absolute disrace. As a Sennett taxpayer I am appauled by these good old boy shanigans. I think its time we see what Mr Weiman actually does all day and if he's qualified. I stopped by Boncas for ice cream Saturday night to check it out. This is a first class operation. Nothing compared to the previous occupant. LET THEM OPEN NOW!!! Good Luck Boncas, thank you for investing in a nice place for residents to enjoy. Paul and Dave - shame , shame, shame!!!!! "

" God for them! They deserve to open. I think the way they have been treated borderlines on harassment. Why would anyone want to block a resident owned business? Yet our local community will welcome in major retailers, and pharmacies with open arms. This community is so worried about liability that they truly forget about what is right. It wil be nice to have a new, resident owned business and not a big box business where they don't care about helping the community. Good for you Bonca's! "

" This is enough! as a town resident,, let them open! Personal conflicts should not be in government.. You went to court on towns money and lost!! Weinman, come out of your pocket with lawyer fees, if you win the town will reimburse you. The people of sennett need to call the town on monday and voice your opinion. It was a restaurant before, and it is still a restaurant, Weiman, where were you before they bought it, did you go in there and make violations? Did you ever eat there? I almost puked when I seen the kitchen prior. They spent Hundreds of thousands on a building in sennett. Who else has done this? The town needs to step in or maybe we'll start asking why town of sennett vehicles are always in auburn on coffee break and at lunch time. Or why some are seen in Skaneateles at the school picking up children!... At $4.00 a gallon maybe town vehicles should stay in the parking lot during these periods. Is Weimans van personal or towns, I see that at the post office in auburn didnt look like official business either. "

" It's an old, sad story, no matter where you go -- entrepeneurs intent on starting (or expanding) a business, providing jobs, tax revenues, etc. VERSUS bureaucrats who seem to take a pervers delight in erecting roadblocks, flexing their state-backed muscles because they can. These are people who've never met a payroll, never created wealth, never contributed anything to society except dotted i's and crossed t's.
I remember the Pioneer -- when I was a kid, on the rare occasions when the family 'ate out,' the Pioneer was one of 2 restaurants we'd go to (the other was Guido's on State St).
Good luck to the owners of Bonca's -- sound like they're going to need it. "

" Of course Weiman and Supervisor David Sikora were unable to be reached. Neither one of them have an intelligble comment to make. Their nonsensical hassling of these businees owners is ridiculous. Please Town of Sennett come to your senses. "
