Bonca's opens without town certificate

Despite the town's refusal to grant a certificate of occupancy for their business, the owners of the new Bonca's restaurant have opened their doors Saturday.
Greg Rigby, one of the partners in the business, said the eatery on Route 20 in Sennett is serving ice cream only at this point. A staff of five workers and Rigby are at the location, and they plan to stay open until 10 p.m. Saturday.

Following an inspection last month, the town code enforcement officer issued a lengthy list of deficiencies he found with the property, the longtime home of the former Pioneer Restaurant. In a letter to the owners, the town warned against opening the business without the certificate.

"The Town will seek an immediate injunction along with damages for attorney's fees and will prosecute you and your partners criminally to the fullest extent of the law," a letter from code enforcement officer Paul Weiman Jr. said.

He could not immediately be reached for comment.

The owners are hoping the town will see things differently if the business actually opens.

"I'm expecting that these guys will come to their senses and see what we've done is not that terrible," Rigby said.

" I bet if you had the investment that they have...you'd be open too...Why should some people with an agenda BE ALLOWED TO BLOCK THE OPENING?...If the health department passed them...and the elctric passed...and the septic & water passed, then what else is there that can't be fixed after they open. "

" Here here!! It's about time the owners of that restaurant stood up for their rights. I'll be sure to stop in tomorrow for some ice cream. That town board needs some lessons in how to be good neighbors. "
