DWI fugitive picked up in Cato

A local man was arrested on a bench warrant Friday after he failed to report to prison for his seventh driving while intoxicated conviction.
Patrick Brennan, 52, formerly of 15 Skaneateles St., Jordan, was picked up by Cayuga County Sheriff's deputies after an anonymous caller said Brennan, who was ordered to report to prison on June 13, was staying at a summer home located in Cato, the sheriff's office said.

Brennan was arrested without incident and placed into the custody at the Cayuga County Jail, deputies said.

Brennan was originally arrested when he was stopped by police on Aug. 25, along Route 31 in Weedsport and arrested for DUI and aggravated unlicensed operation of a vehicle after he left a family event.

Brennan was sentenced to 1.3 to four years in prison June 12, but Cayuga County Judge Thomas Leone granted Brennan one day to say goodbye to his daughter and to take care of personal matters before reporting to prison.

During the sentencing, Brennan had requested to be placed on probation, house arrest or the minimum sentence of 1.5 years.

Brennan's lawyer, Richard Gunger, had argued that a prison sentence would not help his client fight his disease and that his client deserved leniency.

Leone said he would be willing to help Brennan with his alcohol problem but said Brennan, who had also tested positive for marijuana on several occasions, would have to serve prison time for his 10th alcohol related arrest.

“I am not going to tolerate people who are consistently going to break the law,” Leone said during the sentencing. “If you want to be a raging alcoholic, fine. But you got to stay out from behind the wheel of a car and you don't do that.”

During the sentencing, Leone had been hesitant to postpone the prison sentence because there was little additional punishment that could be added onto Brennan's sentence if he were to flee.
