AUBURN - A Harford man was sentenced to one to three years in prison for stealing more than $56,000 in cash and property from C&M Transportation in Moravia.
David Wacht, 24, of 71 Route 30, Harford, had pleaded guilty on March 27 to burglary and grand larceny.
Wacht was also ordered to pay $54,000 in restitution, which would be split with his codefendant and nephew, Ricky Predmore Jr., 21, of 76 W. Main St., Dryden, who pleaded guilty on June 12.
The two men broke into the business Dec. 27 and stole a large sum of cash from a safe, which stored the owner's life savings.
In a statement written to the court, the victim said the two defendants had ruined his business and his life as a result of the burglary.
Also in court:
Cayuga County Judge Thomas Leone ordered a man released from custody after he was improperly arrested by the New York State Department of Corrections for violating his post-release supervision.
Donald Herrington, 30, was never placed on post release supervision by the court as part of his five-year sentence for third-degree burglary and third-degree conspiracy.
Herrington was sentenced on Nov. 18, 2000, to prison for aiding in the planned robbery of an elderly man.
Even though Herrington was supposed to have been placed into supervision under New York state criminal law after he was released from prison, DOCS had no authority to enforce the penalty if the court forgot to add it, Leone said.
Cayuga County District Attorney Jon Budelmann said Herrington, who served the full five years, could not be placed into supervision without returning the case to court.
A local man pleaded guilty to violating his probation in exchange for avoiding prison time.
Luther Stenvick, 51, of 20 Hobson Ave., Auburn, will have to continue to receive treatment for his alcohol problem and refrain from drinking, otherwise he would be sent to prison, Leone said.
Stenvick was originally arraigned on June 3 for violating his probation after he tested positive for drinking alcohol with a .12 blood alcohol content.
Stenvick had been on probation since Nov. 26, when he was sentenced for aggravated driving under the influence.
