A man who violated his probation 98 days after he got out of jail was resentenced in Cayuga County Court Thursday to 2 1/3 to 7 years in prison.
Keith E. Titus, 28, of 33 Pulaski St., Auburn, was arraigned on May 15 when he registered a .09 on a breathalyzer test when he checked in with his probation officer at noon.
Titus was on 4.5 years of probation after spending six months in the Cayuga County Jail for the felony crimes of vehicular assault, driving while intoxicated and operating a vehicle without a license stemming from an accident that injured three of Titus' passengers on Aug. 8.
After being transported to University Hospital in Syracuse, Titus sneaked out the hospital's side door as police entered the building to arrest him. Titus was later arrested after evading police for two weeks.
Titus did not have a license at the time of the accident because it had been revoked when he was convicted of a misdemeanor DWI in August 2007.
During the violation of probation sentencing, Titus said he was a good person who needed a second chance.
Cayuga County Judge Thomas Leone said he gave Titus a second chance when he reluctantly sentenced him to jail instead of prison. Records from the original sentence indicated that Titus was told he would go to prison for the maximum sentence available if he violated his probation, Leone said.
