ALBANY -- New York Attorney General Andrew Cuomo says two statewide drug store chains are selling expired food, medicine and baby formula.
Cuomo says the items were found at 142 CVS and 112 Rite Aid Pharmacies in New York. Many stores sold milk and eggs that had expired, and some sold medications that were more than a year past their expiration dates.

Investigators for the Attorney General's office were able to buy more than 600 expired products around the state. Cuomo says his office is preparing civil lawsuits against the chains.

Calls to CVS and Rite Aid were not immediately returned.

" How is this the customers fault? It SAYS the products were found IN the stores. The delivery people and store employees are supposed to check the dates when they rotate items. It's clearly their fault, as it was stated. "

" I do outside auditing for manufacturers that are concerned with expiration dates on their products. The problem is the clerks that fill the shelves don't rotate the stock, so the new ones are in front and the older products are in the back. If someone just takes a quick check for dates and doesn't dig to the back they miss the expired dates. So don't assume the ones in back are newer. "

" I saw some lettuce at Costco today with a sell by date of 6/11. If that happened at Wegman's, it would be pulled in an instant. "

" Some of the blame has to go to the customers. I always check the dates on everything before buying? Especially grocery stores--Tip-find the products in the back of the shelves it's usually fresher. "
