Man admits to drug charge

AUBURN - A Buffalo man pleaded guilty in Cayuga County Court Thursday to possessing nearly two pounds of cocaine when he was pulled over by New York State Police after he made an illegal U-turn on the state Thruway near Brutus.
Cayuga County District Attorney Jon Budelmann said officers smelled marijuana when they stopped Jermaine Williams, 23, of 423 Lisbon St., Buffalo, at 2 a.m. on Dec. 13.

A search of the car revealed 897 grams of cocaine, 10 grams shy of two pounds.

Williams faces up to six years in prison when he is sentenced on June 26.

Also in court:

• Cayuga County Judge Thomas Leone reserved his judgment on the sex level assessment of a Cayuga man pending an investigation into state case law.

Budelmann said Brian Mattes, 31, of 1076 Connors Road, Cayuga, could be upgraded to a level II sex offender for possessing six photos of child pornography if the case law shows that the children in the photos are classified as victims.

A level II sex offender is deemed to pose a moderate risk of re-offending.

Mattes was arrested in Missouri in July 2006 for possessing the photos on his computer. Records also indicate Mattes may have been chatting with children through various instant messaging services.

While Mattes has had no previous convictions stemming from sexual assault, Budelmann said there was a chance Mattes would re-offend.

Budelmann said Mattes was less than honorably discharged from the Air Force in 1995 after allegations of sexual misconduct with a 14-year-old surfaced and that he that he was fired from a day-care center for being “overly handsy with the children.”

Mattes' attorney, Joseph Sapio, said a board of examiners classified Mattes as a level I offender for a reason and that there was no evidence of prior sexual misconduct in either of the allegations Budelmann mentioned.

A level I sex offender is deemed to pose a low risk of re-offending.

Leone said he would give both parties time to review pertinent case law evidence before he ruled.

• An Auburn man pleaded guilty to criminal possession of a weapon for threatening two people with a pitchfork.

Cleveland Boswell, 39, of 4 Orchard St., Apartment 4, Auburn, faces two to four years in prison.

Boswell will be sentenced on June 19.

• An Auburn woman's probation was restored after she admitted to being convicted of driving without a license in Elmira.

Camisha Bacon, 24, of 1 McConnell Ave., Auburn, will have to complete 50 hours of community service as punishment for violating her probation.

• A Moravia man pleaded not guilty to the felony crimes of assault with intent to cause physical injury and criminal possession of a weapon, and the misdemeanor crimes of menacing, resisting arrest and obstructing government administration.

Troy Kennedy, 33, of 30 Aurora St., Moravia, will re-appear in court on July 17.

Bail was set at 10,000 cash and 20,000 bond.
