Old murder case back in Cayuga County Court

AUBURN - A lawyer for a man convicted of murder almost 12 years ago said Thursday that DNA evidence does not link his client to the murder scene.
Sammy Swift, 54, is serving 25 years to life in the Clinton Correctional Facility for his role in the robbery and murder of Stephen DeLuca Sr. on April 30, 1994. Swift's accomplices, Michele Flowers and her sister Veronica Barr were convicted of robbery and testified that Swift delivered the deadly punches to DeLuca's head.

Blood evidence introduced at Swift's trial was said to have linked him to the murder scene, but the testing at that time was not as advanced as it is today, and more recent tests show that Swift's blood was not found at the crime scene.

" Brew, Fish, no use trying to talk any sense to CM. She'd likely argue that we don't need an appeals process, I'd almost be willing to bet on it!

Pent - exactly right. Detention and incarceration of people "guilty" of using mind altering substances is an abomination in the "so called" freeest country on the planet. (this is not anywhere near true anymore and noone can dispute that fact)

I think even most of the even brain-dead in this country will agree that prohibition of one of the most popular [now legal] drugs [alcohol] was an absolute disaster and created more problems than it solved.

" AJ, agreed!!
cm, is your comment sincere or sarcasm? If it is sincere, it might behoove you to do some research, you will find that the death penalty in fact does not save tax payer dollars. Simply consider the appeals process, which every person sentenced to death is entitled to. This process can and does drag on for decades at further cost to tax payers. If we as a state are willing to kill a human being, we have lowered our selves to the same level as the murderer.
If your comment is sarcasm, I suppose it takes all kinds to make the world go round. "

" To relieve prison overcrowding....LEGALIZE DRUGS...hence freeing up 60 % of the beds in penal institutions.... "

" CM you are sick if you are proposing execution of innocent people to relieve prison overcrowding. Overcrowding can be relieved by releasing those that are in prison for minor drug offenses. Also increasing the funding of the parole system and drug treatment programs would be a bargain compared to the cost of prison. I think a person committed to a life without parole is getting sufficient punishment for a capital crime. Our nation is morally above taking lives for justice. CM doesn't need to watch the Twilight Zone she already lives there. "

" I agree with cm we need to use the death penalty more offten and stop the over crowding in our prison system and to save us tax payers some money "

" CM, if the fact that 100's if not thousands of innocent people are on death row awaiting execution FOR CRIMES THEY DID NOT COMMIT is somehow not disturbing to you and is not as important as ending overcrowding and saving tax dollars, your priorities are very twisted to say the least.

You display a real contempt for fellow human beings.

However, your stance on and illegal and immoral war already proves that.

Have you every watched "The Twilight Zone" - the movie? Maybe you should if you haven't. "

AJ wrote on Apr 17, 2008 8:31 PM:

" Cm, I've never known you for having any kind of rational logic, or more than a modicum of moral grounding, and your comments here are no exception.

You truly have a bizarre mind indeed.

Mizzmom, I agree, but with caveats way too numerous to even get into here. A thorough examination and overhaul of the entire criminal justice system is required.

"

MIZZMOM wrote on Apr 17, 2008 8:12 PM:

" Agreed, but they also need to put real criminals where they belong "

cm wrote on Apr 17, 2008 6:30 PM:

" Disagree AJ, the death penalty needs to be used on a daily basis!
This will end overcrowding and save tax dollars! "

AJ wrote on Apr 17, 2008 5:08 PM:

" Another perfect example of why the death penalty MUST be abolished. "
