AUBURN - An Auburn man pleaded guilty in Cayuga County Court Tuesday to third-degree rape of a minor after he attempted to blame the 14-year-old victim.
Robert Stewart, 53, of 7 Parsons St., said the victim initiated sex after he had fallen asleep after taking pain medications.
“I woke up in pain,” Stewart said. “I woke up and she was on top of me.”
“Blaming the child for the intercourse is particularly disturbing to me,” said Cayuga County District Attorney Jon Budelmann, who added that he had never heard that story from Stewart before.
The rape was not a one-time incident, Budelmann said, but a continuing course of conduct.
Stewart changed his story after Cayuga County Court Judge Mark Fandrich said he would not accept a plea if Stewart believed he was innocent. Stewart admitted he intentionally had sex with the girl on more than one occasion and had fathered a child with the victim.
Stewart could get one to three years in prison when he is sentenced April 15. Stewart will also have to register as a sex offender.
Also in court:
A Syracuse man pleaded not guilty to four charges related to the alleged possession and sale of drugs.
Leeshawn Holmes, 24, of 151 Oak St., Syracuse, will appear in court April 22. Holmes is on parole for a 2004 felony drug conviction.
A Port Byron man's violation of parole case was adjourned while he pursued further drug treatment.
Sonny Smith, 22, of 8535 Denman Road, Port Byron, violated his parole on June 11, 2007, when he left a drug treatment facility against the medical staff's recommendations. Smith was on parole for the fifth-degree criminal sale of a controlled substance in 2006.
Smith has finished his intensive outpatient counseling and passed his drug screening tests as of Feb. 8. Smith's case was adjourned so he could receive a mental health evaluation as part of his recovery treatment.
A man waiving extradition to Florida was told he would stay in New York until his charges here were resolved.
Fandrich said Cayuga County had jurisdiction over Samuel Bulla, 22, and that his pending burglary charges in county had to be dealt with before he could be extradited.
Bulla may be eligible for a shock camp treatment
sentence.
