A man pleading guilty in Cayuga County Court Tuesday to third-degree rape tried to put the blame on his 14-year-old female victim.
Robert Stewart, 53, of 7 Parsons St., Auburn, said the girl initiated sex after he had fallen asleep after taking pain medications.
"I woke up in pain," Stewart said. "I woke up and she was on top of me."
"Blaming the child for the intercourse is particularly disturbing to me," said Cayuga County District Attorney Jon Budelmann, who added that he had never heard that story from Stewart before.
The rape was not a one-time event, Budelmann said, but a continuing course of conduct.
Stewart changed his story after Cayuga County Court Judge Mark Fandrich said he would not accept a plea if Stewart felt he was innocent. Stewart admitted he intentionally had sex with the girl on more than one occasion and that he had fathered a child with the victim.
Stewart is expected to be sentenced to 1 to 3 years in prison when he is sentenced on April 15. Stewart will also have to register as a sex offender.
