DMV investigated, employee fired for troubling testing procedures

ALBANY - The state inspector general says there's no room for confusion: it is not OK for a motor vehicles clerk to help her husband pass his commercial driving test.
After investigators found testing procedures at the state Department of Motor Vehicles office in Peekskill were susceptible to corruption and fraud, the DMV fired employee Crystal Moseley, 39, because she monitored and graded her husband's commercial driver's license test, according to a report released Tuesday by Inspector General Kristine Hamann.

Timothy Moseley needed the commercial “tanker” certification for his job with the Peekskill Public Works Department. His wife had worked 20 hours a week at the DMV and was fired in July.

Investigators said Moseley told them that test takers “cheat all the time.”

Another truck driver, Jason McCloud, 24, offered an $80 bribe for a passing grade on the CDL test. He was charged with 3rd degree bribery of a public servant - a felony.

The investigation began after officials complained that the DMV office was a mill for easily accessible commercial certifications, but those accusations were not substantiated. Hamann's report recommends that the agency review Timothy Moseley's commercial license and consider retesting him. It also recommends reviewing the testing process to look for ways to cut the potential for cheating and explain to DMV employees the penalties for helping test takers cheat.

The DMV is reviewing Hamann's recommendations, Wayne Benjamin, the agency's executive deputy commissioner, said in a written statement.

To obtain the license, which is required to operate commercial vehicles, applicants must pass a written general knowledge test. Additional tests qualify drivers for specific vehicles, including tractor trailers.

Peekskill is 43 miles north of New York City.

Phone numbers for the Moseleys and McCloud were not listed.
