AUBURN -- An Auburn man entered a plea of not guilty during his arraignment on burglary and other charges in Cayuga County Court Friday.
A Buffalo man allegedly involved in the same burglary also entered a plea of not guilty.
Scott A. Cardinale, 27, of 3 McConnell Ave., Auburn, and Ignatius Digaetano, 33, of 49 Belmont St., Buffalo, are charged with second degree burglary, grand larceny, fourth-degree criminal possession of stolen property and fourth-degree conspiracy. Both men are accused of stealing computer and office equipment from a residence on Fort Street in December.
The equipment consisted of a desktop copy machine, fax machine, computer equipment and camera equipment.
Bail for Cardinale was set at $1,000 cash and $2,000 bond and for Digaetano at $12,500 cash and $25,000 bond.
Defense counsel for Digaetano, James Leone, indicated that he will be providing the court with a written application for bail reduction.
Also in court:
€ Donald Richardson, 30, pleaded guilty to third-degree burglary, a lesser included charge in a four-count indictment. Richardson admitted in court to entering a residence at 88 Clark St., Auburn, stealing musical and audio equipment, compact discs, batteries and other objects.
Judge Mark Fandrich promised Richardson, of 5 Church St., currently held at Cayuga County Jail, a sentence of shock probation at $270 restitution.
€ Joseph Bentley, 24, pleaded guilty to third-degree criminal sale of a controlled substance. Bentley admitted to selling an eighth of an ounce of cocaine.
Bentley, of 5 Lawton Ave., Auburn, currently held at the Cayuga County Jail, will be sentenced to shock camp and post release supervision. Fandrich did not specify the length of incarceration.
€ Martin Nagel, 52, pleaded guilty to third-degree criminal sale of a controlled substance. Bentley admitted to selling cocaine to a confidential informant.
Nagel, of 7401 Owasco St., Auburn, and currently out on $20,000 bond, was promised a determinate sentence of 2.5 years in state prison and post release supervision.
€ Michael Bartusiak, 35, pleaded guilty to third degree burglary. Bartusiak admitted to stealing $400 during a home invasion.
Bartusiak, whose last known address is 130 Cottage St., Auburn, was prosecuted by a prosecutor's information, also referred to as a superior court information, rather than having the charge being presented to a grand jury.
Bartusiak entered a guilty plea in exchange for a sentence of shock probation and restitution.
€ Alexander Blanton pleaded guilty to second-degree criminal sex act, a felony, for a crime involving a 14-year-old girl.
Blanton, with a last known address of 22 Eagle Lane, Camillus, will be sentenced to 2.5 to five years in state prison. Blanton will also have to register as a sex offender.
€ Fandrich gave an Auburn woman one more month to comply with the terms of her probation.
Daniella Burg, of 6 Wood St., Auburn, has failed to attend three substance abuse evaluations, according to Cayuga County District Attorney Jon Budelmann. The substance abuse program is part of a sentence of six months in jail, five years probation and restitution of $1,186 handed down in September 2007 for using a stolen credit card to buy $1,386 worth of goods at five stores.
Burg has until March 11 to undergo an evaluation for substance abuse.
€ Chad McDeid, 21, pleaded guilty to third-degree robbery. McDeid admitted to stealing money by threatening the use of physical force in December 2006.
Fandrich did not promise a sentence, he indicated that McDeid would not receive anything worse than shock probation.
€ Charles Allen, who was recently arrested on burglary charges, was remanded to the Cayuga County Jail after allegedly making a statement indicating that he wanted to flee the area.
Allen, 20, of 2465 Dublin Road, Auburn, was arrested on Feb. 5 on burglary charges, accused of breaking into a house near his residence and stealing paintball guns on May 24, 2007.
Allen, who recently pleaded guilty to third-degree burglary for stealing $1,300 worth of paintball guns and supplies from Combat Zone Paintball on Gates Road, Sennett, allegedly made the statement while at probation.
