Lawsuit filed over accident

A woman, whose son was injured in a motor vehicle accident that resulted in the death of an Auburn teenager, intends to sue Cayuga County and the Town of Sennett.
The notice of claim, which was filed Wednesday, states that Lisa A. Zeyak, of Auburn, will seek damages for "wrongful, unlawful, negligent and careless acts and omissions" that she alleges have been committed by the county and town. The notice does not specify an amount, but states that the claim is for personal injuries, pain and suffering, medical expenses, property damage, loss of services, and consequential damages.

At approximately 2 p.m. on Oct. 28, 2007, her son, Kevin Bouley, 16, drove a 2000 Ford Escort from Town Hall Road in Sennett into the path of a Centro bus traveling on Route 20. According to the claim, Bouley sustained a fractured collar bone, trauma, derangement and damage to his knee, and may be permanently impaired.

Sarah E. Smith, 16, of Auburn, a passenger in the Escort, was killed as a result of the accident.

The claim states that the county and town acted negligently by failing "to implement appropriate warnings or traffic control devices, ... to warn of inadequate sight distances, ... to properly inspect of make reasonable inspections of the intersection to determine traffic safety hazards, or otherwise address traffic safety hazards."

Zeyak, who is representing herself, states in the notice that the claim is based on her familiarity with the intersection, as well as the police report and comments from witnesses.

Town of Sennett attorney Don Cheney said Wednesday that he did not want to comment on the claim. County attorney Fred Westphal was not available for comment Wednesday.

" I thought the stop sigh at the end of Town Hall Road was an appropriate traffic control device...The whole situation is tragic but trying to sue the county for her son's inexperience behind the wheel and obvious poor judgement that cost the life of another teen is abhorrent. Something for nothing, nice way to set an example. "

" why dont the parents of the young girl who died sue her son (and her as he was still a minor) for wrongful death because of his negligent driving? perhaps centro sue them also for damages to the bus and loss of revenue from the bus.. and finally maybe the property owner of the land the car landed in sue them for damage to the "landscaping" aka the dent the car left in the dirt?
hmm who else can think of some suggestions to make lawyers more money? "

" Here we go again. People want money for nothing. The mother has to take responsibility as well as her son. The mother should have known her son shouldn't have had other people in the car. Why should the taxpayers have to pay. If she is familiar with the area then why didn't she do something before now. "

" Sad to hear the loss, but 16 year olds are not prepared enough for defensive driving. Looks like someone wants money that they are not getting from their insurance because it was the driver's fault. Name me one road that you cannot not dream up a fault with? The turn is too small, their is a hedge in the way, rocks on the road, etc. More careful driving is needed. "

" This is one reason the insurance rates are so high, you have an inexperience driver, and if Iam not mistaken he was given a ticket also. So his mother blames the town of Sennett, the County and anybody else but her son. The shame of it is that a young lady lost her life to inexperience driver and not the roads. "

" Can people take responsibility for their actions and not blame someone else? You have to be warned that a bus is pulling into an intersection? The town is liable because a light was not located where a tragic accident occured? How do we know that the accident would not have happened if there was a traffic light present? Why didn't he just stop and prevent the accident? If he couldn't stop then he was going too fast. If they don't win this case they should have to pay legal expenses for the town of Sennet. "
