AUBURN -- A Cayuga County Court judge took no action on a request to reopen Costello's Restaraunt Tuesday and scheduled a hearing on an alleged violation of the Clean Indoor Air Act for next month.
The tavern has been closed by court order since Nov. 28 due to a county Board of Health decision owner Patty Glanville challenges.
"My problem here is a matter of economics and a matter of justice," Glanville's attorney Kenneth P. Ray told County Judge Mark Fandrich. "She's been closed for quite some time."
Ray asked the court order to close Costello's be lifted while an Article 78 appeal of the county Board of Health decision is reviewed. The county fined Glanville $1,000 in September for allowing patrons to smoke in Costello's and violating the state Clean Indoor Air Act.
Fandrich took no action on Glanville's request and set a hearing date for Feb. 7.

Costello's is all about a bigger issue which exceeds the City limits of Auburn for all the small thinkers..
We are letting the Government strip us of freedom of choice. If a business chooses to allow smoking then those that do not like it should not patronize the establishment. Let the economics and market sort out who wins or loses.
If you want to smoke - let your insurance company bang you in premiums or cause a person to get a special policy attachment. Or a person could choose to waiver their rights of insurance coverage for any health matter tied to smoking. Once gain ... the freedom of choice.
The State of New York is violating our Federal Constitution. The anti- anything is not a States right to decide. If it is, then abortion should not be a Federal issue.
How long will it be before every diner and fast food restaurant will only be allowed to serve veggie burgers? "
