Costello's shut down

Costello's Restaurant is once again dark, pending review in Cayuga County Court.
The County Board of Health snuffed out all Christmas cheer two weeks ago by citing the bar's owner with a Clean Indoor Air Act violation.

Owner Patricia Glanville said that the order is "indirectly" related to the smoking issue that she has spent the past three years fighting.

She will appear in court Dec. 18 before Cayuga County Surrogate Judge Mark Fandrich.

Glanville said the county served her with a show cause order Nov. 28 and her business has been closed since then.

Her lawyer, Kenneth P. Ray, of Utica, said the Health Department brought the order to enforce the act.

"There are no new charges," Ray said.

"When the county presented the order, it was for flat out closure," he said. "We claim that this order is not based on substantial evidence."

" The only reason they are still wasting the taxpayers money on Costello's is because she had the guts to stand up to Big Brother. Could someone tell me how much was actually spent to date on this nonsense? I know for a fact that other bars allow smoking, but you don't hear anything about them being fined. "

If a law is unfair and unjust, not only is it the right of the people to try and get it changed, but it is their responsibility. " look back on how this whole smoking thing started, you couldn't smoke unless it was a designated area inside, then it went to out side, now you can't smoke anywhere. many businesses have closed because of people who have nothing better to do than watch the people. if you think i'm kidding look at the drinking age when it went to 21. now no smoking in bars or restaurants, soon it will be cars, then your house, where does it end? bottom line is this, you may not like smoking or drinking,but when these people come after one of your pleasures in life, i'm sure you will be yapping "

If your a nonsmoker, don't go to her bar, she pays property tax, she collects sales tax and she pays for the permits to operate the bar, what do you nonsmokers care.
