Teens sentenced to state prison for home invasion

AUBURN - Two Cayuga County teenagers will serve time in prison for their involvement in a 2006 home invasion.
Judge Mark Fandrich sentenced Ryan Martinez and Corey Wooldridge each to three years in state prison Tuesday, in Cayuga County court on second-degree burglary charges.

Martinez, 18, of 88 Rochester St., Port Byron, was also given 18 months of post-release supervision. Wooldridge, 18, with a last known address of 17 Washington St., Auburn, will serve three years of post-release supervision. Both will have to pay $330 in restitution and fees.

Both men admitted to burglarizing a Hobson Avenue resident along with Joseph Kowal in August 2006. According to Chief Assistant District Attorney Jon Budelmann, who prosecuted the case, the victim was awakened at night by a loud crashing sound before finding the three men in his home and his door broken.

When the man tried to call police, Wooldridge knocked the phone out of his hand and hit him with a board, Budelmann said in court. Kowal later returned to the scene with an unknown person and what appeared to be a handgun and demanded money.

Kowal pleaded guilty in August to felony charges and received state prison time.

Before reading Martinez's sentence, Fandrich denied a request by Martinez's defense attorney, Simon Moody, for an adjournment in the case. Moody said his client asked to be with his mother as she underwent a major medical procedure. However, Martinez's mother told Fandrich in court that no procedure was scheduled and that her son “wants to be home for the holidays.”

Martinez requested before hearing his sentence that he receive mental health treatment and drug rehabilitation while serving his time.

Fandrich said in court that both Martinez and Wooldridge have been in and out of the criminal justice system since they were minors.

“I fear for you, but at the same time I have an obligation to protect this county,” Fandrich told Martinez.

During a statement in court before hearing his sentence, Wooldridge said that he was sorry for committing the crime.

“I know what I did, and I know people make mistakes,” Wooldridge said. “I am going to pay for my mistakes.”

Also in court:

• Fandrich sentenced Michael Gatewood to 1 1/2 years in prison and three years of post-release supervision for a drug-related felony. Gatewood, 29, of Nedrow, pleaded guilty to fifth-degree criminal sale of a controlled substance after being arrested in August.

Gatewood has two prior drug-related felony convictions dating back to 1998 on his record, Budelmann said in court. He was on parole for a 2003 felony conviction for criminal sale of a controlled substance when he was arrested.

Defense attorney Joseph Sapio asked Fandrich to consider allowing Gatewood to attend the Willard Drug Treatment program instead of incarceration. Gatewood also spoke on his own behalf before hearing the sentence.

“I think the program would benefit me,” Willard said in court. “I need help. I'm an addict.”

Fandrich said in court that he agreed Gatewood needs help, but he recommend the state Department of Correction's Comprehensive Alcohol and Substance Abuse Treatment (CASAT) program instead.

• An Auburn teenager pleaded guilty after waiving prosecution by indictment to third-degree robbery, a felony. Ryan Tisby, 18, of 15 Fort St., admitted in court to forcibly taking a woman's purse on Oct. 11, an action which caused the woman to sustain minor injuries.

Tisby was initially charged with second-degree robbery. Fandrich agreed to give a sentence of two-to-six years in prison for the plea, pending a pre-sentence investigation. The sentence would make Tisby eligible to attend shock camp, a boot-camp style program, before being released under supervision. Tisby will hear his sentence Jan. 8.

• Raymond Ryle, 41, pleaded guilty to sexual misconduct, a misdemeanor, after his charges were reduced from two felonies of first-degree criminal sex act.

Ryle, whose last known address is Wilmington, Del., admitted to engaging in non-consensual sexual acts with an adult male in a vehicle parked on Madison Avenue in October 2006.

Fandrich promised a sentence of one year in Cayuga County Jail pending a pre-sentence report. Ryle will be sentenced Jan. 8.

• Kenneth Huff Jr., of Brooklyn, pleaded guilty after waiving prosecution by indictment to third-degree attempted criminal possession of a narcotic. Huff, 39, admitted to possessing cocaine with intent to sell on Sept. 12.

Fandrich agreed to promise Huff no more than 2 1/2 years in prison and one-to-two years of post-release supervision, pending a pre-sentence investigation. The sentence would make Huff eligible for shock camp.

• Cheryl Johnson-Ford had her probation revoked after admitting that she committed petit larceny in June. Fandrich gave her two years in prison and two years of post-release supervision. Fandrich also said that he would recommend Johnson-Ford for the CASAT and shock camp programs.

Johnson-Ford, 46, was sentenced to five years of shock probation in 2005 for fifth-degree criminal sale of a controlled substance after she was arrest during a drug bust.
