Woman suing county over son's injury

An Auburn woman is suing Cayuga County for injuries she says her son sustained at a county park.
Sandra Edwards filed suit last week against the county and the Parks and Trails Commission, claiming that both entities failed to leave a public trail in a reasonable and safe condition.

According to the complaint, Edwards and her infant son were walking on the Auburn-Fleming Trail on May 5 when her son fell and suffered severe personal injuries. Edwards is demanding a judgment of an unspecified amount from the county because of what the lawsuit claims as "negligence and carelessness" on the part of the county towards maintaining the public trail.

The Auburn-Fleming Trail is a 1.6-mile scenic stretch connecting Route 34 in the town of Fleming and Dunning Avenue in Auburn. The trail allows people to traverse wetlands, woodlands and farmland on bike or on foot.

According to county attorney Fred Westphal, the claim will be referred to the county's insurance carrier, who will assign an attorney to the case.

"We'll wait to see what happens from there," Westphal said.

" Hey silly rabbit, how do you know it was a 5 year old? The citizen wrote that it was an infant. I am not being sarcastic either. But, if the kid was an infant, how was it walking when it fell? If the kid was really 5, it was short, so it didn't fall far. How did the kid get seriously hurt? My son fell off a bridge abuttment (approx. 20 ft. down) and got a bad ankle sprain, but I didn't sue anyone. And the abuttment was deteriorating. People nowadays just would rather sue than to work. I'm not trying to upset anyone, but just trying to make a point. "

" A wooded area is hardly a place for a child that young. If you want to take your 5 yr old for a walk, walk the nature trail behind the college, go to the lake or to Hoopes Park. Hold your child's hand like a responsible parent is supposed to do. Stop trying to place the blame on others and look at your own part in the child's injuries. Maybe Auburn will start paving nature trails and provide bumpers on the sides of the walkways so no one can possibly get hurt. Silly woman, take care of your child and stop trying to make others pay for your own neglect! Are you going to sue the bicycle company when your child falls off their bike also? It always amazes me how some people are looking for a free ride in life. "
