An Auburn teenager waived prosecution indictment before admitting to a felony drug charge after a late start at Cayuga County Court Tuesday.
Matthew Carnicelli, 19, of 101 Franklin St., pleaded guilty to fifth-degree criminal possession of a controlled substance. On Sept. 4, more than half a gram of crack cocaine was found in Carnicelli's possession, according to Chief Assistant District Attorney Jon Budelmann, who prosecuted the case.

Judge Mark Fandrich agreed to impose a sentence of no more than 2.5 years in prison and two years of post-release supervision, pending his review of a pre-sentence report. That sentence would make Carnicelli eligible to attend the boot camp-style program shock camp before being released under supervision.

" First off, what makes you think he stole anything to procure the stuff? Second, if it were decriminalized and regulated (like alcohol) it would be available more cheaply and one would not need to resort to theft to support a habit (if it became one). As far as drugs are concerned, alcohol is by far and away the worst and damaging drug there is. If any of you who that drink alcohol suggest jail time is the answer, then you're nothing but a hypocrite. And we know what a disaster prohibition was. Please get a clue. "

" It's a health problem until they start committing secondary crimes surrounding the procurement of it, then it's a criminal problem. I don't know how many addicts you know, but most of the ones I've known would steal from their own mother, and have. Incarceration is fine, incarceration and counseling is better. "

" sorry but even 2 yrs isn't long enough to keep him off Auburn's streets. Those of you against prison wouldnt be saying your comments of "no prison" if he LIVED NEXT DOOR TO YOU! "

" Before anyone starts to say health problem or criminal problem was this the last of his "rock" he had to seel or was it for personal use. It may seem a health problem but when he breaks into your house to get money for his next fix ya'll will be screaming he should have been locked up all ready. "

" Exactly right, Pentangelli. If it is a problem at all, it is a health problem and not a criminal problem. We only make matters worse treating it this way. If it weren't so serious it would be a joke. "

" I wonder if this boy's name did not end in a vowel if you would have a problem with the sentence. I am pretty sure you would say it was too light if this individual was a young black man. "

" I guess if you don't break the law in the first place, you stay out of prison. What is so hard to understand about that? "

Pentangelli wrote on Oct 9, 2007 5:45 PM:

" Oh yeah, that's going to solve the problem....put a 19 year old in the slammer where he can learn how to be a real criminal...D"UH...imprisonment for drug use is as absurd as Debtor's Prison....when will we meet the 21st Century with meaningful ways to dissuade drug use...?? "
