UTICA - A man facing 300 years in prison for the murder of a police officer gunned down after a jewelry story robbery was sentenced Wednesday to another 9 1/3 to 28 years in prison for illegally using a Pennsylvania man's identity while he was being prosecuted for the killing.
Toussaint Davis would serve that sentence consecutively with his previous sentence, meaning the 39-year-old Philadelphia man now faces prison time totaling up to 328 years if the sentences are not reduced on appeal, said Assistant District Attorney Kurt Hameline.
An Oneida County Court jury found Davis guilty last month of three counts of forging fingerprint cards and two counts of criminally possessing a forged instrument. Jurors convicted Davis after deliberating just 45 minutes.
Davis was convicted of using the identity of John Healy, 47, of Lower Makefield, Pa., when he was arrested for the slaying of New Hartford Police Officer Joseph Corr after a million-dollar jewelry store robbery in February 2006.
Davis signed John Healy's name to fingerprint cards three different times when he was arrested and police also found two counterfeit driver's licenses in Davis' pocket that indicated he was John Healy, Hameline said.
Davis was convicted in April of second-degree murder under Healy's name. It was not until just before sentencing that authorities learned his true identity. The real Healy reported his personal information stolen in late 2005.
Corr, 30, was gunned down behind a convenience store in Kirkland, as he chased Davis and Walter Richardson, who were running away after their getaway car crashed. Police said the men had just stolen more than $1 million in jewelry and watches from a New Hartford store.
Davis was captured at the scene. Richardson hijacked a tow truck at gunpoint and escaped. He was later shot to death during a gunfight with U.S. Marshals near his home in Chester, Pa. Although it was Richardson who shot Corr, prosecutors charged Davis with murder because he was involved in the crime and escape that led to the killing.
Two other suspects are awaiting trial in connection with the robbery.
