Man spared jail time in felony drug case

An Auburn man will not serve jail time after pleading guilty to selling marijuana.
Jonathan Cramer, 26, of 26 Osborne St., was sentenced Thursday to five years of probation and $360 restitution at Cayuga County Court. Cramer pleaded guilty in August to third-degree criminal sale of marijuana, a felony, admitting to selling 28 grams of the substance.

Chief Assistant District Attorney Jon Budelmann, who prosecuted the case, requested the sentence partially based on Cramer being gainfully employed and having "almost no prior criminal history."

Judge Thomas Leone agreed before reading his sentence, adding that he was "encouraged" because Cramer seemed to be pulling his life together. Leone also warned "there would be no probation" for Cramer if he appears in court again.

" I would not think that 28 grams of pot should ever get you jail town. I mean, how much can that really be, seeing as how I have smoke cigars that were 17 grams of tobacco? I would think that 28 grams would be like a speeding ticket. You know, a fine, a speech to not do that again, and then a wink on the way out the door. "
