AUBURN -- Corey Wooldridge still faces 10 counts after a motion to dismiss was denied by Judge Mark H. Fandrich in Cayuga County Court Tuesday.
Defense attorney Norm Chirco asked Fandrich in March to review the grand jury minutes to ensure that the grand jury was properly constituted and instructed and that the indictment was legally sufficient. Fandrich had reserved judgment until after he had inspected the transcript.
On Tuesday, Fandrich ruled that the grand jury was properly constituted and instructed and upheld the indictment against Wooldridge.
Wooldridge, 18, with a last known address of 17 Washington St., Auburn and currently held at Cayuga County Jail, along with Joseph Kowal and Ryan Martinez, is accused of burglarizing a Hobson Avenue resident in August 2006. They allegedly returned later in the night, displaying what appeared to be a semiautomatic pistol, pointing it at the man and demanding money from him.
Kowal pleaded guilty and was sentenced to state prison time; Martinez is out on bail.
Wooldridge faces a felony assault charge -- second-degree assault -- for allegedly hitting the then 49-year-old man with a board, two felony counts of first-degree attempted robbery, four felony counts of second-degree attempted robbery, two felony counts of first-degree burglary and the misdemeanor of second-degree menacing.
Wooldridge's next court date is Oct. 2.
