AUBURN - An Auburn woman was arraigned in Cayuga County Court Tuesday on 88 felonies charging her with fraudulently claiming unemployment insurance benefits at the same time she worked three jobs.
Leanna Nervina, 33, of 6 Sherwood St., faces 29 sets of second-degree forgery, first-degree falsifying business records and first-degree offering a false instrument for each of several weeks between Oct. 24, 2004, and Jan. 22, 2006, that authorities say she lied to the state Department of Labor about her employment status.
She also faces the felony of third-degree grand larceny for allegedly receiving $4,900 in unemployment at the same time she was employed at Auburn Memorial Hospital, Labor Corporation of America and the Tanning Bed.
Nervina entered a not guilty plea. Nervina has been held on her own recognizance, but her bail was raised to $500 cash or $1,000 bond. Motions are scheduled to be heard 9:30 a.m. Sept. 11.
Also in court:
€ Daniella Burg, 20, of 6 Wood St., Auburn, and currently held in CCJ, pleaded guilty to the felony of fourth-degree criminal possession of stolen property. Burg admitted possessing a stolen debit/credit card May 21.
Her sentencing is scheduled for 9 a.m. Aug. 28.
€ Shelly Hatrick, 36, with a last known address of 7 John St. and currently held in CCJ, pleaded guilty to the felony of third-degree robbery. Hatrick admitted struggling with a man in front of the Cayuga County Office Building and stealing his wallet after the 68-year-old asked her for directions to a pay phone around 2:30 a.m. Nov. 28.
Judge Mark Fandrich committed to sentencing Hatrick to two and a third to seven years in state prison and to consider recommending her for a state prison drug treatment program. Her sentencing is scheduled for 9 a.m. Sept. 4.
€ Leo McGrail, 28, of Apt. D, 88 Clark St., hesitated to enter a guilty plea to the felony of third-degree burglary. McGrail teared up, said he did not understand what was happening and worried that if he did not enter a guilty plea and waive his case's presentation to a grand jury that he would face a harsher sentence after being potentially indicted. Because of McGrail's insecurity, Fandrich rescheduled McGrail to appear next week.
McGrail is charged with the felony of second-degree burglary and the misdemeanors of fifth-degree criminal possession of stolen property and petit larceny in relation to the burglary of his neighbor's apartment May 21.
€ Motion arguments were held in the case of Jeremy Neale, 25, with a last known address of 1 McConnell Ave. and currently held in CCJ.
Neale faces the felony charges of third-degree criminal possession of a controlled substance and fifth-degree criminal possession of a controlled substance and two misdemeanor counts of second-degree criminally using drug paraphernalia. He is accused of possessing crack cocaine, eight ecstasy pills, a digital scale used to package narcotics and baggies April 23.
Fandrich said he would consider if Neale's possession charge should be reduced to seventh-degree criminal possession of a controlled substance - which does not involve an intent to sell - and if a Wade hearing should be held to determine if witnesses can make an in-court identification of Neale, among other issues.
€ Donald Treat, 48, of 7 Washington St., Auburn, entered a not guilty plea to the felony of operating a motor vehicle while intoxicated and the infraction of refusal to take a breath test.
Motions are scheduled to be heard in Treat's case Sept. 11.
