DA would seek two to six years for guilty plea from Raymond

A driver facing manslaughter and homicide charges in a fatal car crash late last summer could possibly face two to six years in prison for a guilty plea.
Sal Piemonte, the attorney for Nicholas Raymond, 19, with a last known address of 6202 West Lake Road, Auburn, requested that a pre-plea investigation be completed so Raymond can be clear what a judge would sentence him to when his case is disposed of.

The matter was addressed Tuesday in Cayuga County court.

Cayuga County normally opts for a pre-sentencing investigation that is completed after a defendant enters a guilty plea and before a defendant is sentenced.

Raymond is accused of leaving an injured passenger, Timothy Hutchings, 19, without seeking help following a Sept. 2, 2006 car accident in the front yard of 2850 Sand Beach Road, Fleming.

Hutchings died within hours of the accident.

Raymond faces the felony charges of second-degree manslaughter, criminally negligent homicide and leaving the scene of an fatal motor vehicle accident without reporting and the vehicle and traffic infractions of an unlicensed operator, speed not reasonable and prudent and failure to keep right.

The district attorney's office has offered to recommend Raymond be sentenced to two to six years in state prison in exchange for pleading guilty to leaving the scene of a fatal motor vehicle accident and two counts of criminally negligent homicide, Chief Assistant District Attorney Jon Budelmann said.

The investigation will be due for an Aug. 7 court appearance.

I have knowm Mike for better than 45 years, since the old Y-Field days and will be more than pleased to work his campaign & support him 110%. In all respect to his possible opponnet in a primary I hope Dave will think this through and do what is right for the city and not carry his personal feelings to the political arena. The party needs to stand united behind the approved candidate, Mike Quill & not split it's loyalitys. " I hope the judge is listening -- alternative sentencing would be totally appropriate in this case. Nothing "light" -- a young man is dead because of another young man's criminally irresponsible actions. But sending him to prison only makes the outcome more likely that A) the kid will be abused and made a victim himself in a way no one deserves and B) that given the way our prisons work, he's more likely to come out a life-long criminal than be reformed. Some sort of heavy pennance, lasting much longer but not involving going to prison makes much more sense. Maybe even serving on the other side of the bars in a prison, to see daily reminders of where he could be, maybe work with victims of crimes and accidents and their families, something that both continually reminds AND gives the opportunity to do something useful and productive to make restitution. "

" This is very sad. I would almost guarantee he feels extremely remorseful. This will be a very heavy burden to bear for the rest of his life. I'm not sure how prison is going to help, in fact it could do the opposite. If indeed he is guilty as it appears from the reporting, he should do some sort of pennance, but not necessarily in the form of a penitentiary. Anyone up for a discussion of real justice? Alternative sentencing? Criminal justice reform? "
