AUBURN - A Syracuse man scheduled to go on trial this week pleaded guilty in Cayuga County Court Monday to the felony of third-degree criminal sale of a controlled substance.
Charles N. Vaughn, 32, of Syracuse, currently held in Cayuga County Jail, faces at least six years in state prison at his Aug. 9 sentencing. Vaughn declined an offer - open until recently - that he plead guilty to the felony of third-degree attempted sale of a controlled substance in exchange for a sentencing commitment of four years in state prison.
Vaughn faced two felony charges of third-degree criminal sale of a controlled substance, two felony charges of third-degree criminal possession of a controlled substance and the felony charge of fourth-degree conspiracy.
Vaughn admitted Monday to a crack cocaine sale to an undercover police officer June 10, 2006. Codefendant Shana Barnett, 25, of Syracuse, previously pleaded guilty to the felony charge of fifth-degree criminal sale of a controlled substance and admitted driving Vaughn so he could deal drugs.
Vaughn was sentenced in 1994 to five to 15 years in state prison for the felony of first-degree attempted robbery. Vaughn and his codefendants robbed a local man, Jamie Scholz, of money and drugs. Scholz was stabbed several times.
Vaughn was represented by Norm Chirco. Chief Assistant District Attorney Jon Budelmann prosecuted the case.
Also in court:
€ Angelo Amodei, 41, of Poplar Ridge, entered a not guilty plea to two felony counts of driving while intoxicated, the misdemeanor of second-degree aggravated unlicensed operation and the vehicle infractions of drinking alcohol in a motor vehicle, speeding and failure to obey a police officer.
Amodei is accused of driving with a .14 blood alcohol count around 1:33 a.m. April 29, on East Brutus Street, Weedsport, and ignoring a Weedsport village police officer's red flashing lights and siren.
Amodei said he failed to appear at his first arraignment date because he was working out-of-town and did not receive the telephone message about the arraignment. His bail was set at $5,000 cash or $10,000 bond. Amodei has a similar, but older, case pending in Auburn City Court. Motion arguments are scheduled in the County Court case for Aug. 9.
€ Motions were argued in the case of Jennifer Clark, 39, of Rochester, who is facing two counts of third-degree criminal sale of a controlled substance, three counts of third-degree criminal sale of a controlled substance and one count each of fourth-degree criminal possession of a controlled substance and fourth-degree conspiracy. Chirco was granted access to the search warrant and search warrant application used in Clark's case.
Clark is accused of selling narcotics and supplying a lower-level dealer with crack cocaine in exchange for assistance in trafficking the drugs.
€ Floyd M. Lamphere Jr., 23, of 849 Howell Road, Conquest, was sentenced to 1-1/3 to 4 years in state prison, $320 in state surcharges and a $1,000 supplemental sex offender fee for the felony of second-degree rape, a statutory rape charge. Lamphere had sex with a 13-year-old girl in a field July 3. An order of protection was issued for the girl.
€ Elwood Raymond, 26, of 41 Park St., Auburn, and currently held in Cayuga County Jail, entered a not guilty plea to two felony counts of first-degree sexual abuse and two misdemeanor counts of endangering the welfare of a child.
Raymond is accused of abusing a 7-year-old boy and abusing a 5-year-old girl in the town of Niles in February. He was acquitted in a 2001 jury trial of abusing a 6-year-old girl.
Motion arguments are scheduled for Aug. 9. Raymond's bail was set at $5,000 cash or $10,000 bond.
€ James Scott, 23, of 144 VanAnden St., and currently held in CCJ, entered a not guilty plea to the felonies of second-degree assault and third-degree criminal possession of a weapon. Scott is accused of slicing a 17-year-old's face in front of The Roadhouse at 92 Clark St., Auburn, around 2 a.m. March 25.
He is serving one year of local jail time for each of two misdemeanor crimes of false personation and petit larceny related to a liquor store burglary July 2. Scott's bail was set at $20,000 cash or $40,000 bond. Motions in his case are scheduled for Aug. 9.
€ Phillip G. Seaton, 19, of Cato, pleaded guilty to the felony of second-degree attempted rape, a statutory rape charge. Seaton admitted attempting to have sex with a 15-year-old girl. His sentencing is scheduled for July 12.
€ Maurice Southall, 26, of Lyons, declined a plea bargain offer and is scheduled to go on trial July 23 or Aug. 13. Southall faces six felony and two misdemeanor drug charges.
€ Daniel Wilson, of Medford, Ore., and currently held in CCJ, entered a not guilty plea to the felonies of third-degree grand larceny, three counts of fourth-degree criminal possession of stolen property and three counts of first-degree falsifying business records.
Wilson, who is in his 40s, was extradited from Oregon to face the charges and had a last known local address of 14 James St., Auburn, as of 2003. Wilson is accused of fraudulently using credit cards at local businesses to make more than $3,000 worth of purchases.
Motions in his case are scheduled for Aug. 9.
€ Corey Woodward, 27, of 165 Perrine St., Auburn, and currently held in CCJ, pleaded guilty to the felony of first-degree criminal contempt in exchange for a sentencing commitment of one year in the CCJ. Woodward admitted pushing a woman in violation of an order of protection March 23.
Woodward's sentencing is scheduled for July 26.
