AUBURN -- A Rochester man was sentenced to two years in state prison and two years post-release supervision for being present during a crack cocaine sale Dec. 14, 2006.
Derrick L. Holmes, 33, of 40 Colgate St., was accompanying two drug-dealing codefendants and had a history as a middle man for drug deals, according to Chief Assistant District Attorney Jon Budelmann.
Holmes was asked to take an oath to tell the truth in Cayuga County Court Tuesday. Under questioning by Budelmann, Holmes clarified that drugs recovered with a codefendant were not his and that he had just been accompanying his codefendants.
Justice Thomas VanStrydonck, the Administrative Judge of the Seventh Judicial District, also sentenced Holmes to participate in a boot camp-style program during his state prison term.
VanStrydonck was filling in for Cayuga County Surrogate Judge Mark Fandrich.
Codefendant Darryl Lawhorn, 36, of 192 Morton St., Rochester, has been sentenced to 3.5 years in state prison and two years post-release supervision for the felony of third-degree criminal sale of a controlled substance.
Codefendant Jennifer Clark, 38, of 48 Hillendale St., Rochester, still has her case pending.
