A teenage driver has been indicted by a Cayuga County grand jury on felony charges of second-degree manslaughter and criminally negligent homicide related to the death of his passenger following a Sept. 2 high-sped crash into a tree.
Nicholas Raymond, 18, with a last known address of 6206 West Lake Road, Auburn, was indicted on the manslaughter, criminally negligent homicide and four vehicle and traffic infractions. Cayuga County District Attorney James Vargason announced the indictment in a news release Tuesday.
When he was originally arrested, Raymond was charged with leaving the scene of a fatal motor vehicle accident, a class E felony.
One of Raymond's passengers, Timothy Hutchings, 19, died following the accident on Sand Beach Road in Fleming in which Raymond allegedly was driving after drinking beer, without a license and at a high rate of speed, Vargason said. Raymond allegedly abandoned Hutchings in the vehicle.
Hutchings was found with massive head trauma four hours after the 3 a.m. accident.
"Nicholas Raymond has an affirmative duty to seek medical care for his seriously injured passenger, and his conscious and deliberate decision to leave him there for hours without help sealed Timothy Hutchings' fate. It was deplorable and I believe constituted manslaughter. The grand jury agreed," Vargason said in the release.
