Raymond now facing manslaughter charge

A teenage driver has been indicted by a Cayuga County grand jury on felony charges of second-degree manslaughter and criminally negligent homicide related to the death of his passenger following a Sept. 2 high-sped crash into a tree.
Nicholas Raymond, 18, with a last known address of 6206 West Lake Road, Auburn, was indicted on the manslaughter, criminally negligent homicide and four vehicle and traffic infractions. Cayuga County District Attorney James Vargason announced the indictment in a news release Tuesday.

When he was originally arrested, Raymond was charged with leaving the scene of a fatal motor vehicle accident, a class E felony.

One of Raymond's passengers, Timothy Hutchings, 19, died following the accident on Sand Beach Road in Fleming in which Raymond allegedly was driving after drinking beer, without a license and at a high rate of speed, Vargason said. Raymond allegedly abandoned Hutchings in the vehicle.

Hutchings was found with massive head trauma four hours after the 3 a.m. accident.

"Nicholas Raymond has an affirmative duty to seek medical care for his seriously injured passenger, and his conscious and deliberate decision to leave him there for hours without help sealed Timothy Hutchings' fate. It was deplorable and I believe constituted manslaughter. The grand jury agreed," Vargason said in the release.

" what has this city come to????? It is a tragic accident that happened, but that is why they are called accidents!!!! Do you really think this boy should get the max for a "ACCIDENT"? My heart goes out to both families, but what about the other teenagers that were involved? How come they aren't facing the max??? They are all guilty if you ask me, not just one individual. I hope that when this goes to court, people really pay attention to the facts, and not just point their finger at one. Is this case really about justice or is $$$$$$?? "

Many kids these days are dieing senselessly and the driver's are being charged with manslaughter whether it be from a dwi or just wreckless driving. None of the others are children of cops. They are treated as exactly what they are! Victims!!!! Victims who deserve justice regardless of who their parents are. It is really sad to think that all in the car can't be prosecuted. Everyone that knew of this accident is just as guilty and should be just as responsible. I hope someone is working on making that a law. Lord forbid there were be more kids in this world that would do such a horrible and cowardly thing but just in case we need a law to make all responsible. "

" We can feel sorry for everyone involved in this incident. But there has to consequences when actions demonstrated by these young adults result in death. Far to many people want to look at the the people involved and then decide what should happen. The grand jury looked at the crime and made the decision. "
