Negotiations have collapsed in a possible settlement to the suspension of the commander of the Cayuga County Sheriff's Law Enforcement Division.
Lt. James K. Langler was suspended March 9. The reason for the suspension has not been made public.
“We will not have any sort of settlement,” said Randy Ray, an attorney with Cayuga-Onondaga BOCES, which handles labor relations for the county.
A hearing has been scheduled for Wednesday, May 25. A previous hearing was postponed pending negotiations.
“They're the ones that basically pulled the plug,” Ray said.
Langler's attorney with the Hoffmann, Hubert and Hoffmann law firm did not return a phone call Friday.
Langler is entitled to a hearing under Section 75 of the state's civil service law, which sets out a due process for public employees.
A hearing officer will be able to recommend a penalty, but the decision would not be binding.
Langler has worked for 15 years for the sheriff's office, following stints with the U.S. Marine Corps and the Fairfax County (Va.) Police Department.
Sgt. Michael Wellauer has been promoted to take over Langler's duties. The promotion is considered temporary pending the outcome of Langler's hearing.
