Indians need to obey our laws

Enough already!
Now the Seneca Indians are saying that we're trespassing on their land when we drive part of the state thruway.

This is how utterly absurd our dealings with Indian tribes has become. I have a solution to this whole mess which we'll discuss in a minute. But first let's review some of the highlights of how our brilliant politicians got us here. Back in 1997 the Indians pulled this same deal by blocking the thruway. Governor Pataki was forced to mobilize the state police, which resulted in violent confrontations with the Indians and set the tone for the rest of Pataki's administration.

Namely, whenever there was a conflict between New York and Indian tribes you could always count on Pataki to buckle under. Anything to prevent a repeat of the thruway violence. And the Indians have played that trump card over and over again, using it as a threat against the people of New York.

Either we go along with whatever they want or things could get nasty again, has been the message. Has it worked for them? You bet. In 2003, they sold almost $350 million in cut-rate tobacco products without paying a red cent in taxes.

But now Gov. Eliot Spitzer has started talks to explore the possibility of Indians paying taxes so they (the Indians) are once again threatening us. And the last time they threatened us they started burning cars. I think the people of New York have had enough of this nonsense. It's finally time for a grassroots movement to rescind all treaties with Indian tribes.

Indian tribes have the right to celebrate and share their culture, even live in organized communities if they choose to, but they should be treated under the law like every other American citizen.

All Indians should become ordinary tax-paying citizens like the rest of us. This idea of having independent nations existing within American borders is stupid. And when we say they should be paying taxes on cigarette sales, guess what? They better pay up like all other citizens. Otherwise, it gives them an unfair advantage over other merchants. You know, like it says in the equal protection clause of the U.S. Constitution. We're all supposed to be treated equally as citizens of the U.S.

But as George Orwell once said, it appears that some of us are more equal than others. This has got to stop. The land belongs to us now and we aim to keep it. Spitzer needs our support in his battle against the tribes. And a good place to start is to organize a growing movement to end all treaties and shut down all reservations.

" Article VI, Clause 2 of the U.S. Constitution states that treaties "shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding." In 1976 the Seneca Nation and the State of New York executed a memorandum of understanding allowing the state to build Route 17 on Seneca territory. In clause 2, paragraph f of this agreement the state promises to "encourage and support legislation which, for the purpose of promoting and facilitating industrial development on the Nation's reservations, provides relief from state taxes, including corporation and excise taxes, for corporations and enterprises which commence commercial activities on the Nation's reservations." Then what would you have done with the mostly very-poor who eek out an existence within a community that at least nominally cares about them? Would you advocate government help for them? NO!! You, being the despicable Conservative that you are, would rail against how they'd be living on the public dole! You don't have the ability to think through a trip to thr toilet! "

" I love the line about George Orwell..Judy..how about you start accepting the gay community..aren't you more equal than them? But why should someone on such a high horse accept the lower rung of society. Its a proven fact that its all too easy to hate, but oh so hard to accept. Practice what you preach and stop being so pathetic. Who is running the Citizen these days..David Duke? "

I agree! wrote on Apr 25, 2007 1:04 PM:

" I agree with you Judy. Let's start giving Gays and Lesbians their equal rights and lets start taxing Churches. At that point we can talk about taxing Indians for the 1/10,000th of the land they once held. "

One America wrote on Apr 25, 2007 9:33 AM:

" I agree Chris one America would be wonderful, however it is important that you know , “these Indians” as Judy has so eloquently called them, are not asking for anything new, or that we pay back anything that our Forefathers did to their Ancestors. Judy is saying that we should rescind on not just our word, but our contracts and tell them too bad for you. That logic is not only Un-American it is simply fascist and shows the exact same thought process as the Nazi’s. "

It comes down to right and wrong wrote on Apr 25, 2007 9:18 AM:

" Well Dave, it is nice that you know the Pledge of Allegiance. However, she is talking about the US Constitution, you have heard of it haven’t you? Look it up, read the first 10 bill of rights and then pick up a history book you will see that this country has broken all 10 of them in their dealings with the Native Americans. Of coarse the Constitution and the Pledge of Allegiance themselves could be argued in dealings with Native Americans, but you are the ones that bring them up therefore you should use them consistently, not conveniently . Look up the definition of liberty, look up the definition of the words you write, you will see that Judy is not right, it is not about race based privileges it is about, race based prejudices and legal contracts. They own the land in question, who are you, Judy or anyone else to say too bad for them. You would both be screaming if someone even thought about taking your possessions. What cracks me up is that you are both, in a need of a history lesson (not a little sewing circle of you and your friends thinking you know what your talking about and feeding off one another’s ignorance, a real history lesson by a historian or even a book, just not your like minded friends) and should first look up the treaties and contracts in question BEFORE you speak about them, if for no other reason then to not look ignorant. "

" I do not agree with Judy but it is time to put the past ills behind us. We need to heal as a country and come together as one for the sake of our future. We cannot pay for the past idiocy of our forefathers over and over again. We need to consider ourselves "Americans" and take off the Native, African, Anglo, Asian, etc and come together as we are meant to be. "

" "Anything to prevent a repeat of the thruway violence." Do you call this a sentence? Or how about this slaughter of the English language: "Either we go along with whatever they want or things could get nasty again, has been the message." You by far are the worst writer The Citizen has had in years, and it has nothing to do with your warpped idealogy! Take your hate somewhere else, Evildoer!!! "

" "Its ONE Nation under god ( you can worship who ever you want. Even a tree or your Harley who cares) indivisible. With liberty and justice for all." Race based privilages are wrong in this country. Try to justify that folks? Judy is right I'll add its time to remove all race baised special treatment. Tribal sovereignty needs to go. "

Knock it off and find someone worth the price of paper. "

" You want to rescind all treaties -- are you recommending that anyone who doesn't like a contract previously agreed upon should be able to rescind it?! What if the people you bought your house from came back and told you they changed their mind, they want to rescind the contract and move back in? What if the company you bought your car from came to your house and took the car back because they decided to rescind the agreement? What if Russia decided they wanted to rescind the agreement in which we purchased Alaska -- do you think we should just give it back? How ignorant are you to suggest that a government should just rescind all treaties -- who would ever negotiate with our government again? You are an ill-educated, ignorant, small-minded woman and you have no business writing anything for pay. The Citizen should be ashamed of printing your drivel. "

Your whole article is contradicting itself wrote on Apr 24, 2007 1:41 PM:

" Please, if your going to use the US Constitution, in regards to matters of Native Americans. You should first remember the little thing called the BILL OF RIGHTS. Lets see how many of those we have followed when dealing with the Native Americans. If we all followed the Constitution the same way you want these “Indians” to follow it, then you yourself would not be an American. You do know that it states that you are not allowed to go into someone’s house and claim it as our own even in times of war. You do know that your people came here and committed genocide against their people. Would you even think to say “it’s time the Jews start upholding the laws of all Nazi’s” The government made these agreements with the tribes to get what they wanted at the time. They thought not having to pay taxes looked like a great deal at the time when they seen these people as nothing more then “savages“, but low and behold they learned to play the white mans game, and NOW you cry it’s not fair. The Constitution states that States may govern themselves when other wise not stated in the Constitution, legal contracts where drawn up and signed regarding these matters. You expect your bank to hold up its agreement with you regarding your homes, cars etc. this is no different. I say they should pay taxes in the same monetary form you paid them, with beads and feathers. Just because one might chose to ignore the history of their people does not mean it does not exist. Before you want to use the constitution to try to prove your obviously prejudice opinions of these so called “Indian tribes” you had better know your history and your Constitution and be ready to move off their land you unlawfully seized. You said “And a good place to start is to organize a growing movement to end all treaties and shut down all reservations.” That my friend is a huge contradiction their rights in the same Constitution you are asking them to follow. "

" "The land belongs to us now and we aim to keep it." HOW DISGUSTING!!! How closed-minded are you? Their land does not belong to us! IT belongs to them. Reading this article makes me sick. I am an American, but I am ashamed of our history. You want to take that history and make it our present! You are supposedly a Christian and Catholic, and yet you seem to be the first to judge and condemn people which is surely not something Jesus would approve of. I pray that God will help you to become a more open-minded. I pray that you will think about things and learn the true facts before you say or print them. God teaches us to be loving and forgiving. He doesn't teach us to hate, control and condemn as most of your articles seem to. "

Just because someone was too stupid to use birth contol and now has a gaggle of kids does not mean I should have to subsidize their utilization of municipal services. You can't call for equality with one breath and then look for priveledges for "families" with the next. It exposes you for the true hypocrite that you are. "
