Romulus man indicted on sexual abuse charge

AUBURN - A Romulus man was arraigned in Cayuga County Court Tuesday on a grand jury indictment accusing him of sexually abusing a young girl in the Auburn Memorial Hospital parking garage while the two waited during a family member's medical appointment in September 2005.
David Foster, the attorney for Robert F. Sherman, 63, of 5149 Route 96, Romulus, entered a not guilty plea on Sherman's behalf to the felony of first-degree sexual abuse and the misdemeanor of endangering the welfare of a child.

Sherman's bail of $2,000 was maintained.

Motions are scheduled to be heard in Sherman's case June 12.

Also in court:

€ Shean Barney, 41, of 13159 Arnold Road, Ira, pleaded guilty to the felony of second-degree criminal possession of marijuana.

Barney admitted to having 47 pounds worth of six-foot-tall marijuana plants on his property Aug. 25.

Barney's sentencing is scheduled for May 22.

€ Cayuga County Surrogate Judge Mark Fandrich ordered that Raymond Clyde, 35, a state prisoner currently held in Upstate Correctional Facility, give a saliva sample to compare to crime scene evidence.

Clyde's attorney, Doug Bates, objected on his behalf.

Clyde has entered a not guilty plea to the felony charges of first-degree attempted rape, two counts of second-degree assault, first-degree unlawful imprisonment and first-degree promoting prison contraband.

He is accused of attempting to rape a female civilian employee in the loading dock area behind the Auburn Correctional Facility's mess hall July 7, assaulting her and using a bed strip cloth to try to bind the wrists of the employee.

Clyde is also accused of assaulting one of the male employees responding to the noise of the struggle.

Clyde is currently serving 20 to 50 years for the New York County convictions of first-degree rape, first-degree sodomy, first-degree robbery and first-degree burglary.

€ James Morell, 38, waived his right to an extradition hearing and agreed to voluntarily return to New Jersey.

New Jersey authorities will have 30 days to pick him up to face the allegation he violated his parole for a 2002 robbery conviction.

€ Wayne Matthews, 19, of Apt. 1, 13 Easterly Ave., Auburn, was sentenced to three years in state prison and two years of post-release supervision for the felony crime of third-degree criminal sale of a controlled substance.

Matthews sold crack cocaine in Auburn Oct. 14, 2005.

Fandrich ruled Matthews was eligible to serve his state prison sentence in a bootcamp-style setting, but he rejected the application for Matthews to be considered a youthful offender.

€ Fandrich granted Shawn Streeter, 23, of 26 Virginia St., Baldwinsville, the right to have hearings held on whether his statements to police would be admissible for use at a jury trial; what, if any, prior criminal convictions would be allowed in a trial; and if physical evidence recovered by the police is admissible at trial.

Streeter faces the felony charges of second-degree assault and third-degree criminal possession of a weapon and a misdemeanor charge of fourth-degree criminal mischief.

He is accused of stabbing a camping companion at Fair Haven Beach State Park 3 a.m. Aug. 4 and slashing the tires of a vehicle belonging to a third person.

Streeter's attorney, Norm Chirco, also requested he receive medical records of the alleged victim to assess if the charge Streeter faces is legally sustainable.

€ Troy Swan, 38, a Cayuga County Jail inmate, with a last known address of 31 Congress St., Moravia, was sentenced to 1.5 to 3 years in state prison for walking away from a work detail deployed to the jail's two-acre inmate produce garden last June.

Swan, who was released on parole in 2004 for a North Carolina robbery conviction, was serving a sentence at the county jail for fourth-degree criminal possession of a weapon.

The garden is located behind the CCJ on a contiguous parcel of county property.

Joseph Sapio, an attorney assigned to assist Swan in representing himself, immediately filed an appeal of Swan's conviction through a guilty plea in exchange for the promised sentence.

Fandrich had ruled against Swan's and Sapio's argument that that the charge of second-degree escape should be reduced on the basis that the charge applies only to inmate flights from a detention facility, not to inmate flights from outside a detention facility.
