County: Smoking returned to Costello's

AUBURN - In July, after a long battle with county officials, the owner of Costello's Restaurant in Auburn agreed to order her patrons to snuff their cigarettes in compliance with the Clean Indoor Air Act.
But Cayuga County officials reported Tuesday that on March 16 patrons allegedly smoked cigarettes in the restaurant, lighting up what may become round two of a battle with the restaurant.

During Tuesday's county Board of Health meeting, Eileen O'Connor, director of environmental health for Cayuga County, began discussing a recent investigation of the restaurant. County Attorney Fred Westphal motioned the meeting into executive session to discuss the investigation.

During executive session, committee members discussed the allegation that people were seen smoking inside the restaurant, Westphal said.

Restaurant owner Patty Glanville refused to comment on the allegation Tuesday afternoon.

“These activities may become a violation of Judge Fandrich's order,” Westphal said.

Cayuga County Surrogate Judge Mark Fandrich in June allowed Glanville to keep the establishment open after paying a $1,000 fine, taking down signs stating that smoking was allowed and applying for a food service permit.

Westphal will first contact Fandrich before deciding further action.

Westphal said he has not been in touch with Glanville.

Prior to Fandrich's order, Glanville refused to obtain a food service permit because she said she didn't serve food.

The county originally tried to shut down the Aurelius Avenue bar because Glanville didn't have a food service permit and allowed customers to smoke cigarettes inside.

" I believe our lawmakers do have important issues to resolve. Smoking? Shut down the manufacturers of cigerettes. Simple. Just like any other drug. Smoking is personal. Why not close all types of achohol producers also. Lawmakers should be saving jobs, improving healthcare, education, safety of public at large against violent acts. Cigarettes are legal at a certain age I wish as much effort was put towards drugs & alcohol. No just cigarettes & second hand smoke. Old. Shut down production no more problem? We are all going to die. Stress, lack of healthcare, drunk driver, cancer, etc. Think people. Those that don't smoke stay out of it. We all make choices. The government never used to have to think for us. Oh yeah remember coffee out of coffee pot is HOT!!! Judgement. "

" The intent of the no smoking law was to protect employees so that they would not be exposed to smoking in the work place. Since the owner of Costello's has NO employees, the law should not apply there. The county needs to look at its own employees smoking in the entry to county buildings before continuing to pick on the owner of Costello's. "

" The difference between smoking and drinking is quite simple. If I open a bottle of beer in a bar room nobody is physically harmed. Actions after that beer may result in harm but that is very different. If I light up a cigarette I just directly impacted the health of every other person in that bar. Second hand smoke is an extremely harmful substance. More harmful in fact than the first hand smoke the smoker so gleefully puts down their throat. So the difference should be obvious. "

" I think the government is way to intrusive in our daily lives. I think an establishment has the right (as smoking is not outlawed in the Constitution) to determine if smoking is to be allowed. It is still PRIVATE PROPERTY and the owner can choose who he or she wants to attract to this business. It should be up to the patron to decide where they want to go. If they want to go to a business where smoking is allowed, they can go. Conversely, if a person doesn't want to go where people smoke, they don't have to go there. They can go someplace else. I don't smoke, but as far as I know, it's still a legal activity. "
