Teen receives eight-year prison term

A 17-year-old was sentenced today to eight years in state prison and five years post-release supervision for trying to kill an acquaintance by cutting his throat while he slept.
The sentence Cayuga County Judge Thomas Leone chose for Cody L. Anderson, 17, originally of Red Creek, fell between the sentences requested by the Cayuga County District Attorney's Office and Anderson's counsel, David Elkovitch.

Chief Assistant District Attorney Jon Budelmann had asked for a 15-year prison term. Elkovitch requested a six-year prison term and that Anderson be considered for youthful offender adjudication.

Anderson could have been sentenced between five and 25 years in state prison.

Anderson walked through the open door of the male victim's Foote Street, Auburn, apartment at 3 a.m. Aug. 29, went into his bedroom and cut his throat with a metal blade.

" Eight years for attempted murder??? He entered someone else's home and tried to murder him! Where is the justice? He deserves a much longer sentence. "

" I'm sure he will learn his lesson and come out of the penal system corrected. Good thing he didn't try to kill him. If he had, he probably would have deserved a longer sentence. Man, it sure is hard to type with your tongue so firmly embedded in your check. "

" very sad that a 17 year old went to the extremes and ruined his life with something he felt he had the right to cause injury or murder on another human being. Hopefully he learns to find other avenues for anger while he is in prison. "
