ALBANY - Saying New York is losing an estimated $270 million annually from Indian sales of untaxed cigarettes, a state senator called Sunday for negotiating deals with the tribes to collect taxes and evenly split revenues.
In a 28-page report, Sen. Jeff Klein, a Democrat from Westchester, said the state cigarette tax increased 39 cents to $1.50 a pack in 2002, but tax receipts have declined from $1.12 billion in 2003 to $979 million in 2005.
Under federal law, tribal members buying cigarettes are exempt from state cigarette taxes, but nonmembers are not.
