Fearon returns as chairman

AUBURN - Less than 48 hours after George Fearon resigned from the Cayuga County Legislature, he was handed back his legislative seat and chairman position Tuesday night.

Peter Tortorici, R-Auburn, and Daniel Schuster, D-Auburn, unsuccessfully challenged Fearon for the chairman position during the 2007 reorganizational meeting.

“I'm displeased with the outcome and concerned with the direction the Legislature is going,” Tortorici said.

Four legislators voted for Tortorici while Schuster both nominated and voted for himself. Tortorici, Minority Leader Michele Sedor, David Pappert, R-Auburn, and Chris Palermo, R-Sterling, voted for Tortorici.

“I appreciate the confidence the majority expressed. You can't hold high office without some people having problems,” Fearon said.

Two members of the public expressed their concerns with the reinstatement of Fearon as chairman, encouraging legislators not to vote for him.

“George Fearon violated the trust of his office. George Fearon violated the trust of the chairman's office. George Fearon violated the trust of the public,” Jerry Morgan said.

Pappert first motioned to appoint Fearon to fill the District 7, Springport, legislative seat he vacated Monday in order to receive retirement benefits from Union Springs Central School, where he previously worked.

Schuster motioned to appoint Aurora Town Board Trustee, George Farenthold, to fill the seat instead. The motion was defeated 11-2.

Fearon was elected 9-4 to fill the legislative seat. Sedor, Tortorici, Pappert and Schuster voted against this reappointment.

Paul Dudley, R-Cato, nominated Fearon to serve as the 2007 chairman. Chris Palermo, R-Sterling, nominated Tortorici for the chairman and Schuster nominated himself.

“I wasn't comfortable with voting for either of the Republicans. They decide things behind closed doors,” Schuster said. “I would like to say to the public that this is an election year and the Republicans aren't letting public into the process. Republicans have the majority, we really don't have a say right now no matter what we do.”

Following Fearon's oath of both offices, he assured the audience and legislators that he will only receive only one retirement package from the school and not from the county.

“I will receive retirement benefits from only one system, but am eligible to two,” Fearon said. “The county will not have to make contributions toward my retirement.”

In other news:

- Linda Murphy, R-Auburn, was designated majority leader to the Legislature. Michele Sedor, D-Sennett, was designated minority leader.

- Ann Petrus, R-Brutus, and County Coroner James Dolan were sworn into office Tuesday night.

- Bernie Smith, R-Throop, was elected county vice chairman.

- Lee Brew, clerk of the Legislature, was reinstated by the Legislature 13-1. Michael Lepak, D-Auburn, voted against the reinstatement due to a clerk salary increase.

- Legislators voted 14-0, approving the creation of an austerity spending plan for the county. A 2/3 weighted majority vote will now be required to purchase equipment more than $1,000 or to establish a Capital H project. New capital improvement or renovation expenses greater than $1,000 need the weighted majority along with any transfers from the unappropriated fund balance.

" Now that Mr. Fearon has backed doored his way back into the legislative Chair postion, maybe he will forfeit that 30K salary back to the tax payers for authorizing US to spend an extra 30k of OUR money to clean up the rest of the county buildings. That was BAD business Mr. Fearon. Deals like that will secure your "Buddies" bids forever because when you back door bids like you did, no legitimate company will ever want to submit bids for work in this county. I am not going away Mr. Fearon. "

" motioned Mr. Fearon's appointment because it was a Ways & Means resolution, the committee he chaired. He specifically mentioned that the resolution was signed by a majority, but not all, of the Ways & Means committee. Legislator Pappert voted against Mr. Fearon's appointment, AND against Legislator Fearon's candidacy for the Chairman position. I feel it is clear where he stands. "

" Were Carole Leonello's argument a fruit, it would be a soft and mushy one, a rotten one... the kind that, under a little pressure, falls apart and leaks between cracks. Essentially she's saying we should all keep our mouths shut unless we have smoking guns in our possession. I'd ask her to think about this for a moment and then if that doesn't do the trick, I'd ask her to wake up and take a look at the real world instead of the pretend one she apparently inhabits. " What I witnessed last night was partisan politics at its worst. George Fearon, Ray Lockwood, Paul Dudley, Ann Petrus, Mitchell, Steve Cuddeback, Linda Murphy, and Bernie Smith have all violated the trust placed in them by the tax payers of this county. But is the problem really the back door dealings that went on last night? Or is it voter apathy? Would they have done what they did if the chambers were packed with angry citizens? I don't think so. Ultimately ladies and gentlemen it is our responsibility, it is our responsibility to ensure politicians serve US, not serve us up on a platter. Last night Peter Tortorici, voted against re-appointing George Fearon, and he voted against his appointment as Chair, Why? His answer was simple and straight forward, "Because it was the right thing to do." He knew when he went into caucus, if he didn't tow the line they were going to strip him of his position. He was warned. He responded," My constituents have told me that they are opposed to the Re-appointment of George Fearon", "My constituents have told me that they are opposed to Mr Fearon obtaining the Chairmanship." Ladies and gentlemen, this took courage, to stand up against the individuals who essentially had the power to cut him off and leave him out in the cold. This is exactly what happened. He will chair no committees, which means he will receive no steipends like the rest of them. I don't know if you are aware of it or not but the County Legislature AWARD themselves with MONEY for every committee they chair, and for every position the hold. This costs US thousands of dollars extra every year, and it goes toward their retirement as well. With this said I wish the public would stand up and do what is right for our County. We need to be united againat the corruption that is plaquing this county. Peter Tortorici, did the right thing, we need to support him and others who are willing to fight for what is right in our community. Thank You "

" Mr Fearon may have issues of his own to answer for, but look who tried to slither into his seat in a blatant back-door manuver. Given the smarmy Mr. Farenthold's naked ambition and thirst for political influence, it should come as no surprise. Still, I am bemused by this need in someone so unqualifed to be dealt into the game. But Mr Farnenthold lacks both the appeal and the smarts to get himself elected to such a postion (he does, howeve, suffer from no shortage of chutzpah) so he tried to seize the seat in whatever underhanded manner that he could. Deplorable. "

" If these public figures were just private citizens, then I would agree with your assessment. But, as an educator, you know that anyone who works for the public, paid for by taxpayer money, is fair game to public opinion. In my humble opinions, I do believe that these CC legislators are "bums" and "sorry dopes". These comments are not personal attacks, they are assessments of the job these legislators are performing using my tax dollars. I don't know these legislators personally, I'm sure they are fine upstanding citizens. But I don't agree with their dirty corrupt politics. Now, if you think I don't have a right to say this, or that the Auburn Citizen should not post this, then I guess I am wrong and my right of freedom of speech is truely dead. "

" You might realize that your strategy for communicating your message was not persuasive to support your opinion with verifiable data. In so much as your message says, as I read it, you have grave difficulty relating to individual comments, selected vocabulary and opinions that don't present conclusive facts or data of some kind. Well, public comment comes in many forms. Quite frankly, I have difficulty following your train of thought so I suggest you keep it for those 8th grade lesson plans because I am college educated like yourself but it's a tad bit too stuffy for me. If, as a county resident you are not infuriated by the actions of the Legislators re-appointing Mr. Fearon last night, I suspect you will feel quite differently when your Tax bill ( please excuse my lack of verifiable data $$$$$$$$$$ as it does not exist )arrives to cover the costs which may ultimately be paid by everyone in Cayuga County. If you are so offended by reading the comments of others who choose to express themselves here, in whatever manner, I suggest you stop scrolling. Everyone is entitled to post. Everyone has the right to their own opinion whether they meet your standards or not. "

" I've attempted to follow The Citizen's coverage of the Cayuga County Legislators' appointments, particularly Mr. Fearon's. I've yet to read fair, substantiated, and unbiased reporting on this controversial issue. As an educator,I teach and model strategies for dialectic communication (persuasive essays and speeches). This process includes formulating opinions on issues and supporting them with researched authoritative facts based in part, on verifiable data. Perhaps your antagonistic letter writers as well as your editorial staff should take a lesson from 8th graders. Statements based solely on opinion are premised on stereotypes, perceptions and emotions, therefore , do not reflect intellectual investigation of "truths". Furthermore, it appears that The Citizen violated their written policy that states they will not publish comments that contain "Personal attacks, insults , or threats". Yet one opinion posted on their website, dated 1/02/07 at 10:51 PM, calls elected officials "bums". Another comment posted on the same evening at 10:45, contains several accusatory and threatening remarks as well as calling Mr. Fearon and his colleagues "sorry dopes". In conclusion, I encourage persons to refrain from personal attacks; voice opinions that can be supported with corroborated evidence. Lastly, perhaps our hometown newspaper can practice responsible journalism without using yellow journalism tactics. "
