Woman's sentencing postponed over childcare

AUBURN - A Syracuse woman was given two more months to secure care for her children - including a five-week-old infant - before being sentenced for her second drug felony.
Chianti McIntyre, 32, with a last known address of 940 W. Lafayette Ave., Syracuse, had come to Cayuga County Court Thursday with the infant and other family members.

She said that the only support system she has is her mother, and her mother wasn't capable of caring for her children because of a drug addiction. “I don't have anyone to take care of my baby,” McIntyre said.

Her sentence had already been postponed until after her pregnancy due date.

Judge Peter Corning said that he thought it would do more damage to have McIntyre placed in shackles Thursday with her children left without reliable care.

“I'm doing this for your children, not for you, very frankly,” he said.

Because of a prior conviction, McIntyre must be sentenced to some state prison time, possibly to be served under parole supervision at the Willard Drug Treatment Campus. McIntyre was convicted in 1994 of the felony of third-degree criminal sale of a controlled substance.

In this pending case, she sold crack cocaine June 22, 2005, to a police informant. Her new sentencing is scheduled for March 1.

Also in court:

€ Jessica McMann, 29, of 6170 Lake St., Cayuga, was sentenced to 1.5 years in state prison, which will be served in the Willard paroled supervision program. McMann was sentenced for the felony crime of fifth-degree criminal possession of a controlled substance. McMann possessed 34 tablets of Ecstasy Feb. 9 in the city of Auburn.

McMann has three prior felonies convictions of second-degree attempted assault.

€ Eric Tuttle, 21, with a last known address of Utica, was sentenced to five years probation and $645 restitution for the felony of third-degree criminal sale of marijuana. Tuttle sold 28 grams of marijuana Jan. 31, 2005, within Auburn city limits.

€ Whitt White, 24, of 28 Perry St., Auburn, was sentenced to three years in state prison for the felony crime of second-degree assault and one to three years in state prison for the felony crime of third-degree burglary. The sentences will run at the same time.

White admitted to burglarizing Jake's Liquor Store with two others July 2. He also admitted that - while out on bail following his arrest for the liquor store burglary - he stabbed a man in the back with a knife around 2 a.m. July 23, at the intersection of Perrine Street and Rock Avenue in Auburn.
