Two more charged as part of fatal crash

Two young men were charged this week with providing alcohol to underage drinkers as part of the state police in Auburn's investigation into the Sept. 2 accident that caused Timothy D. Hutchings' death.
Hutchings, 19, died from massive head trauma sustained in the accident in the front yard of 2850 Sand Beach Road, Fleming. He was found in the abandoned SUV more than four hours after the 3 a.m. crash. The SUV's driver, Nicholas Raymond, 18, of 6206 West Lake Road, Auburn, has been charged with the felony of leaving the scene of the fatal motor vehicle accident and the lesser charges of driving without a license, speed not reasonable and prudent and failure to keep right.

State Police Senior Investigator David Stebbins said that the alcohol the two allegedly procured probably did not contribute to the accident's cause.

An Auburn 16-year-old was arrested Tuesday and charged with the class A misdemeanor of first-degree unlawfully dealing with a child. The 16-year-old also was a passenger in the vehicle in which Hutchings died. The Citizen does not name minors under the age of 18 who are charged with misdemeanors.

Ian T. Nolan, 22, of Lizette Street, Auburn, was arrested Monday and charged with the class A misdemeanor of first-degree unlawfully dealing with a child. Both the 16-year-old and Nolan were issued tickets to appear in Fleming Town Court Tues., Dec. 19. Stebbins wouldn't expand on whom the two allegedly provided alcohol to or how a 16-year-old obtained alcohol. Anyone older than 16 can be charged with unlawfully dealing with a child as long as those receiving the alcohol are under the legal drinking age.

Stebbins said that he couldn't address if the 16-year-old faces criminal liability for any actions regarding the accident. He said that decision would be made by the Cayuga County District Attorney's office after the state police's investigation is over and the entire case is given to the DA. He said the investigation continues.

In addition to Raymond, William Brown Jr., 20, of 27 Evans St., Auburn, has been charged with providing alcohol to the underage party police say Raymond was at before the crash. Ashley Hadden, 18, of 2158 W. Genesee St. Road, Aurelius, whose father Gary had the SUV registered in his name, has been charged with fraudulently reporting the SUV stolen at 3:30 a.m. Sept. 2. Both their misdemeanor cases are pending in Auburn City Court.

Stebbins said that the 16-year-old's and Nolan's alleged provision of alcohol was in the town of Fleming and separate from the Auburn party.

He said that the investigation of an accident and related parties can “uncover crimes unrelated to the accident.”

Tim would have helped anyone of those boys out of the vehicle. Instead he gets left there to die? He might still be here if 911 had been called so I say lets charge everyone that did something to contribute. As far as a police officers son goes... Hes a good man. His wife is a wonderful lady! " I was with you "Let's get this straight" until you got to the part of parenting/education. The children of this community are educated in what to do if...bla bla bla...the reality is, they'll tell Officer Hutchings the correct answers as he's in the classroom educating and reinforcing what to do, however, outside the classroom, with a few beers in them or peer pressure, the story changes. Get real. And parenting? Are we placing judgement of the children's parents? That's an awful big surmize for you to do. Children today yes do have more than when we were growing up, and are handed more, however, the foundation that a parent gives to the child in younger years no matter how strong, will be tested in moments such as these. As a former teenager and lucky to be alive today, I made choices that were wrong and although I never got "caught", it's a numbers game like anything else in life. And my parents? I apologize to them for what I put them through just like I'm sure the children in this case will. None of us are perfect. And we don't know if it was one of the others the car what Tim would have done to help. There will always be unknowns because that is life. We need to pray for the families and for the Hutchings family to forgive if they have not in order to move on during this unfortunate circumstance. "

" Look people....each and everyone of us here did something illegal. Whether it be drinking under age, using cigarettes underage or even smoking some grass (which im sure most of you still do - ha,ha). The major difference though comes from the kids' PARENTING and DISCIPLINE from their elders! Eventhough I knew I was doing something wrong, the big thing for me was NOT getting caught; which meant using the 3lb tissue lodged between your ears & some common sense! Me and all of my buddies knew NOT to get into a car after drinking, or to do anything STUPID to get caught because our PARENTS would of whipped our tails something fierce. You WALKED everywhere you had to go...or took a cab or rode your bike. Its not rocket-science folks. But,when kids are handed cars, $$$ and everything else from their parents and dont konw what it means to work for anything or appreciate anything - this is what happens. Kids today are so stupid....but alot of that stupidity comes from the lack of education and parenting. "

I think that it is great that the other people involved in the accident are being charged. But you just dont hear all this being done for other teenage victims that this happens to. "

" No matter who the victim is, the police department have the responsibility to thoroughly investigate every aspect and to be fact finders. If the father were a doctor, a sanitation worker, or an unemployed person, the police should treat the case no differently than they are this case. No matter who the father is, he is still a grieving parent who would like to have the case solved. Get real, Auburnians! Instead of being judgmental of the police department which is trying to solve a case, why don't those of you who are so critical volunteer to speak to the young people who may be the next victims so that the police department can focus its attention on other critical areas. " It is not just "underage" drinking that is the problem in our community and every community in our great country, it is DRINKING period. The judgement of those who drink in excess and whether it's to get into a car, commit another crime or do something that is out of character due to the the lack of inhibitions that the drug allows, is a fact of life...be it a teenager, or an adult. Drinking and the influence that alcohol has on someone, bares no socio-economic lines nor gender and unfortunely plays a part in 99% of peoples lives. You either live with someone or know of someone who somehow has been touched by the affects of alcohol. So as many are enjoying the holiday cheer during this season and get into your car, because you only had a couple---will you be thinking about the possible consequenses for your actions or will you turn the key and drive? This case has touched many families due to the amount of children involved. Though the loss of the Hutching's child is a loss no parent is ever ready to deal with, this case has also been difficult for the families of the children who physically survived it--and have we thought about the psychological affects? God be with them all. "

" Parents, per say, can raise up their young ones and teach them the dangers of drugs and alcohol, but ultimately when it is time to let them go to make some of their own decisions, peer pressure gives way to parental control, and the child succumbs. Any parent who says "won't happen to my kid" is not facing reality. Shame on those who point the finger of blame on anybody but those who serve alcohol to minors. This is truly a great tragedy. All of us, as parents, and adults, need to watch out for other people's children as well as our own. We should not close our eyes and say "it is not my kid, not my business" when we see kids making wrong choices. " For whatever reason the case is getting the attention, underage drinking is a huge problem that needs to be addressed by all parents...the only people who can effectively teach their children about consequences. All kids/students/ underage drinkers need to be aware of this tragedy to see and feel what the consequences can be. As adults we need to be aware and actively fighting this battle. "
