An Auburn father has been indicted by a Cayuga County grand jury on charges he recklessly caused the death of his 4-year-old daughter by driving drunk and crashing a motor vehicle July 21.
Jerry L. Lamphere, 31, with a last known address of 59 West St., Auburn, has been indicted on felony charges of second-degree manslaughter and second-degree vehicular manslaughter in a high-profile case in which his daughter, Brooke Lamphere, died.
Lamphere crashed his vehicle on Potter Road in Throop around 2:56 a.m. July 21 following a domestic incident with his estranged wife, Stacey L. Lamphere.
If convicted, Lamphere could face up to 15 years in prison for the most serious felonies.
Authorities said at the time Lamphere was threatening to drive off the cliff with his daughter and another child during a domestic incident which Stacey fled to call police from her mother's home.
During the crash, Lamphere's vehicle became airborne and flipped. Brooke was partially ejected through the rear window.
Authorities said then she was not in a carseat.
Lamphere has also been indicted on the misdemeanor of second-degree criminal contempt, two misdemeanor counts of endangering the welfare of a child and two misdemeanor counts of driving while intoxicated.
He was indicted on the vehicle and traffic infractions of failure to keep right, operation of a motor vehicle with a child not restrained in an appropriate child restraint seat and failure to stop at a stop sign.
The criminal contempt charge relates to Lamphere's alleged violation of an April 18, 2005, Auburn City Court order of protection by allegedly going to Stacey's residence while intoxicated, taking the children from the residence without her knowledge, harassing her during a telephone conversation and failing to stop his vehicle and return the children.
Lamphere has remained incarcerated at the Cayuga County Jail since his arrest.
He is scheduled to be arraigned Tuesday, Nov. 21, in front of Cayuga County Judge Mark Fandrich.
Also indicted:
€ Timothy M. Gower, 16, of State Street, Syracuse, and David A. Travers, 17, also of State Street, Syracuse, were indicted on two felony counts of third-degree criminal possession of stolen property.
Both teenagers are accused of the possession of a stolen 2006 Jeep Wrangler and other items worth over $3,000 Oct. 23, on Route 38A in Moravia
€ Troy Swan, 37, of 31 Congress St., Moravia, was indicted on the felony charge of second-degree escape.
Swan is accused of escaping from the Cayuga County Jail around 10:45 a.m. June 18. He allegedly took off from a work detail deployed to the jail's two-acre inmate produce garden, which is located outside of the jail.
Swan was a few days away from the end of his sentence.
€ George L. Vreeland Jr., 39, of 4137 Cork St., Scipio, was indicted on the felony charges of third-degree grand larceny and fourth-degree grand larceny and the misdemeanor charge of second-degree scheme to defraud.
Vreeland is accused of defrauding his father's business, Hourigan Farm, and its customers by taking more than $30,000 owed to the farm by listing his mailing address as the bill's return address in September 2005.
Vreeland is accused of stealing $28,000 and $2,400 in two separate instances.
