AUBURN - An Ira man's bail was set at $100,000 cash or $200,000 bond during his Cayuga County Court arraignment on nine felony rape, kidnapping, assault and criminal sex act charges.
Paul Carey, the attorney retained for Harold Calkins, 21, of P.O. Box 166, White Cemetery Road, Ira, had asked Tuesday for bail to be reduced to $20,000 cash or $40,000 bond after Calkins' bail was set at $250,000 cash or $500,000 bond in Sterling Town Court.
Calkins is accused of threatening to kill an 18-year-old woman July 1, cutting her with a knife and forcing her to perform different sexual acts with him in a wooded area in Sterling.
Carey said Calkins lives with his parents and was employed at a drywall business. He also said the victim has mental issues.
Chief Assistant District Attorney Jon Budelmann said Calkins committed an “extremely brutal rape” that included death threats and the use of a knife.
Calkins has been indicted by a grand jury. He faces the felony charges of three counts of first-degree rape, two counts of second-degree assault, three counts of first-degree sexual act and one count of second-degree kidnapping. Motions are due to be argued in the case Oct. 24.
Also in court:
€ Lakeisha Flowers, 25, of Apt. 1, 431 Elliot St., Syracuse, was released on her own recognizance following her guilty plea to fifth-degree criminal sale of a controlled substance.
Flowers' mother, an Auburn resident, said she was hard-pressed to pay even the bail level of $1,000 cash or $2,000 bond and that her daughter was needed to help settle her young child into the new school year.
Flowers admitted selling crack cocaine March 7. Her sentencing is scheduled for Oct. 10.
€ Craig Lawton, 45, with a last known address of 91 Washington St., Auburn, had his sex offender level set at two, a moderate risk of reoffending. Lawton was sentenced in June to one year in Cayuga County Jail for the felony crime of third-degree criminal sex act related to abuse of a teenage girl that occurred over the course of three years.
€ Goldie Rose, 28, with a last known address of Apt. 3, 79 Cottage St., Auburn, was sentenced to five years probation for the sale of marijuana. Rose was convicted of a felony of third-degree criminal sale of marijuana.
Rose was tearful as she told Fandrich she had disappointed his expectations and her own by selling the marijuana to a police informant. “Sometimes I think I'm my own worst enemy,” she said.
Fandrich said he was sentencing her to probation because of her two small children. She also was sentenced to pay the Auburn Police Department $180 for the drug buy money in lieu of the $270 state felony surcharge.
€ Sonny Smith, 20, with a last known address of 129 Melone Village, Auburn, was restored to probation on the condition he complete outpatient drug treatment at the Confidential Help for Alcohol and Drugs agency and accept other mental health services. Smith's church minister has agreed to take him in and ensure he makes all his appointments.
Smith was sentenced in April to five years probation and four months of weekend work release at the Cayuga County Jail for the felony charge of fifth-degree criminal sale of a controlled substance. He sold crack cocaine to a police informant Nov. 20, 2004.
